All public swimming pools shall comply with Chapter 9 of the New Jersey
State Sanitary Code (N.J.A.C. 8:26-1.1 et seq.) relating to the construction,
location, alteration, operation and maintenance of public swimming pools;
and all violations are hereby declared to be nuisances hazardous to health.
Three copies of the Code hereby established and adopted shall be placed on
file in the office of the Township Clerk and shall remain on file for the
use and examination of the public. It shall be unlawful for any person(s)
or any body corporate to construct, alter or operate a public swimming pool
as defined in and governed by Chapter 9 of the New Jersey State Sanitary Code
without first having procured a license from the Health Officer upon the recommendation
the Board of Health, or to construct, alter, maintain or operate a public
swimming pool without complying with any or all of the applicable provisions
of Chapter 9 of the New Jersey State Sanitary Code.
The annual license fee to be paid for operating a public swimming pool
shall be the sum of $30.
Licenses issued for the operation of a public swimming pool shall expire
annually on April 1 and applications for renewal shall be submitted, together
with the required fee, prior to April 1 each year.
Licenses may be denied or suspended by the Health Officer for failure
to comply with the provisions of this section of the Code. The Health Officer
shall afford the person whose permit has been denied or suspended an opportunity
to be heard in a public hearing before the Board of Health. Following such
public hearing, such person shall be informed of the Board's decision
and the reasons therefore.
Any person violating any of the provisions of this chapter shall upon
conviction thereof pay a fine of not less than $25 nor more than $500 and/or
be subject to a term of imprisonment not exceeding 90 days, or both. A separate
offense shall be deemed committed on each day during or on which a violation
occurs or continues.
