Pursuant to the authority of the Municipal Home
Rule Law of the State of New York, the Town Board of the Town of Clarkstown
has found it necessary for the health, safety and general welfare
of the inhabitants of the Town of Clarkstown, in the area outside
of the incorporated villages, to enact a local law regulating electrical
installations to safeguard to a reasonable degree life and property
from the hazards caused by improper electrical wiring.

The chief inspector and each of the duly appointed
inspectors of the electrical inspection agency approved by resolution
of the Town Board, hereinafter referred to as "inspector," are hereby
authorized and deputized as agents of the Town of Clarkstown to make
inspections and reinspections of all electrical installations heretofore
and hereafter described and to approve or disapprove the same. In
no event, however, will the cost or expense of such inspections and
reinspections be a charge against the Town of Clarkstown.
A.
It shall be the duty of the inspector to report, in
writing, to the Building Inspector of the Town of Clarkstown, whose
duty it shall be to enforce all provisions of this chapter, all violations
or deviations from or omissions of the electrical provisions of the
New York State Uniform Fire Prevention and Building Code applicable
to the Town of Clarkstown and all local laws, ordinances and the Building
Code as referred to in this chapter insofar as any of the same apply
to electrical wiring. The inspector shall make inspections and reinspections
of electrical installations in and on properties in the Town of Clarkstown
upon the written request of an authorized official of the Town of
Clarkstown or as herein provided. The inspector is authorized to make
inspections and reinspections of electrical wiring, installations,
devices, appliances and equipment in or on properties within the Town
of Clarkstown where he deems it necessary for the protection of life
and property. In the event of an emergency, it is the duty of the
inspector to make electrical inspections upon the oral request of
an official or officer of the Town of Clarkstown.

B.
It shall be the duty of the inspector to furnish written
reports to the proper officials of the Town of Clarkstown and owners
and/or lessees of property where defective electrical installations
and equipment are found upon inspection. The inspector shall authorize
the issuing of a certificate of compliance when electrical installations
and, equipment are in conformity with this chapter The inspector shall
direct a copy of the certificate of compliance be sent to the Town
of Clarkstown to the attention of the Building Inspector. No certificate
of occupancy shall be issued by the Building Inspector until a certificate
of compliance has been filed with the Building Inspector.

The electrical inspection agency(ies) approved by resolution
of the Town Board is (are) expected to operate in a professional and
competent manner. If the Building Inspector determines that an electrical
inspection agency is not performing its duties in the best interest
of the inhabitants of the Town of Clarkstown, he shall notify the
Town Board of this failure to perform. The Building Inspector may
request such agency be suspended for a period of time or permanently
removed from the list of approved electrical inspection agencies.
It shall be a violation of this chapter for
any person, firm or corporation to install or cause to be installed
or to alter electrical wiring for light, heat or power in or on properties
in the Town of Clarkstown until an application for inspection has
been filed with the New York Board of Fire Underwriters. It shall
be a violation of this chapter for a person, firm or corporation to
connect or cause to be connected electrical wiring in or on properties
for light, heat or power to any source of electrical energy supply
prior to the issuance of a temporary certificate or a certificate
of compliance by the New York Board of Fire Underwriters.

Any person committing an offense against any
provision of this chapter shall be guilty of a violation punishable
by a fine not exceeding $1,000 or by imprisonment for a term not exceeding
one year, or by both such fine and imprisonment. The continuation
of an offense against the provisions of this chapter shall constitute,
for each day the offense is continued, a separate and distinct offense
hereunder.
