For the purposes of this chapter, certain words
and terms used herein are defined as follows:
APPLICANT
The owner of land proposed to be subdivided, or the owner's
duly authorized representative.
CONSERVATION EASEMENT
An undeveloped or landscaped area used to protect, improve
or enhance lands due to special environmental or other conditions.
CONSTRUCTION PLAN
The maps or drawings accompanying a subdivision plat and
showing the specific location and design of improvements to be installed
in the subdivision in accordance with the requirements of the Planning
Board as a condition of the approval of solid plat.
CONSTRUCTION STANDARDS AND SPECIFICATIONS
The standards and specifications adopted by the Planning
Board and approved by the Town Board for the construction of new subdivision
streets and related improvements.
DESIGN CHANGES[Added 8-8-2000 by L.L. No. 10-2000]
Changes made to approved plans that alter the intent, layout
or design of the approved subdivision plat or its approved grading
plan.
A.
Examples:
(1)
Alteration of site grading, utilities or drainage
due to a change in the type or style of construction, including redesign
of intended structure(s).
(2)
Clearing or removal of trees from a portion
of a site in contradiction to an approved subdivision plat.
(3)
Relocation of catch basins or other infrastructure.
EASEMENT
Authorization by a property owner for the use by another
and for a specified purpose of any designated part of his property.
FIELD CHANGES[Added 8-8-2000 by L.L. No. 9-2000]
Changes that must be made to approved plans resulting from
previously unknown or undiscovered physical field conditions, provided
that such changes shall not alter the intent, layout or design of
an approved subdivision plat or its grading plan.
A.
Examples:
(1)
Springs discovered during site excavation.
(2)
Underground rock formations.
(3)
Other environmental conditions deemed to be
of such consequence that a change is necessary.
LOT
A parcel of land, not divided by streets, occupied or to
be occupied by one or more principal buildings and accessory buildings
or uses customarily incident thereto, including such open spaces as
are arranged and designed to be used in connection with such buildings.
A lot may or may not coincide with the land shown as a lot on a duly
recorded plat.

LOT, FLAG
A lot not meeting minimum frontage requirements and where
access to the public road is by a narrow private right-of-way or driveway.

MASTER PLAN
A comprehensive plan for development of the town prepared
and adopted by the Planning Board pursuant to § 272-a of
the Town Law, and includes any part of such plan separately adopted
and any amendment to such plan or parts thereof.
OFFICIAL MAP
The adopted Official Map of the Town of Clarkstown of Rockland
County, pursuant to § 270 of the Town Law.

OFFICIAL SUBMITTAL DATE
The date on which a subdivision plat is officially submitted to the Planning Board pursuant to § 276 of the Town Law and upon completion of SEQR, which is hereby defined as the date of the next regular meeting of the Planning Board following completion of the application procedure outlined in §
254-11 of this chapter.
PRELIMINARY PLAT
The preliminary drawing or drawings indicating the proposed
manner of layout of the subdivision to be submitted to the Planning
Board for its approval.
RESUBDIVISION
A change in a map of an approved or recorded subdivision
plat, if such change affects any street layout shown on such map,
or area reserved thereon for public use, or any change of a lot line,
or if it affects any map or plan legally recorded prior to the adoption
of any regulations controlling subdivisions.
SEQR
The New York State Environmental Quality Review Act.
STREET
Includes streets, roads, highways, avenues, lanes or other
ways.
STREET, DEAD-END
A street or a portion of a street with only one vehicular
traffic outlet.
STREET, MAJOR
A street which is used primarily as a route for traffic between
communities or large areas.
STREET PAVEMENT
The wearing or exposed surface of the roadway used by vehicular
traffic, excluding curbs.
STREET, SECONDARY
A street which serves or is designed to carry traffic from
local residential streets to the system of major streets.
SUBDIVIDER
Any person, firm, corporation, partnership or association
who shall lay out, for the purpose of sale or development, any subdivision
or part thereof, as defined herein.
SUBDIVISION
The division of any parcel of land into two or more lots,
plots, sites or other divisions of land, with or without new streets,
for the purpose, whether immediate or future of transfer of ownership
or building development, and shall include resubdivision.

SUBDIVISION PLAT
The final map or drawing, described in §
254-29 of this chapter, on which the plan of a subdivision is presented to the Planning Board for approval and which, if approved, may be submitted to the County Clerk for recording.
SURVEYOR
A person licensed as a land surveyor by the State of New
York.
ZONING REGULATIONS
The officially adopted Zoning Regulations of the town, together
with all amendments thereto.
