To effectuate the implementation of this chapter of the Village Code,
the Board of Trustees of the Village of South Glens Falls is hereby authorized,
pursuant to Article 56 of the General Municipal Law, to contract with any
other municipality or qualified not-for-profit animal shelter for the services
of the Animal Control Officer.
The duties of the Animal Control Officer include the authority to:
A. Enforce any provision of this chapter within the Village
of South Glens Falls.
B. Cooperate with and work in conjunction with the Village
Police Department and adjacent municipalities to enforce the provisions of
this chapter and the provisions of any applicable state statute in the Village
of South Glens Falls.
C. Issue a summons and complaint in the appropriate court
if there is a violation of this chapter or the state statutes in the Village
of South Glens Falls.
D. Seize, contain or impound any animal found on any public
roads, streets, sidewalks, highway or other public places within the Village
of South Glen Fails when said animals are determined to be in violation of
the provisions of this chapter.
E. Appear in the appropriate court to prosecute any violations
of this chapter as may be required.
F. Compel compliance with the provisions of the Agriculture
and Markets Law of the State of New York.
G. Aid and assist in the filing of complaints or other legal
process as may be required.
H. Facilitate removal and disposal of any animal carcass
as prescribed by law.
It shall be the responsibility of the Animal Control Officer to:
A. Maintain accurate records and to complete and submit
the following records to the Mayor and Board of Trustees on a monthly basis
or when requested by the Mayor and Board of Trustees:
(1) A listing of all complaints, including the name, address
and phone numbers of each complainant and the type of complaint and the resolution
of each complaint.
B. Make available any other records required to be maintained
by state or federal law.
Any person owning or harboring an animal for a period of seven days
prior to the filing of any complaint alleging a violation of this chapter
shall be deemed to be the owner of such animal for the purpose of this chapter.
In addition to the provisions set forth in this chapter, the seizure
of animals, redemption periods, impoundment fees and adoption of animals regulated
by this chapter are to be governed by the Agriculture and Markets Law of the
State of New York.
