The purposes of this chapter are to:
A. 
Operate and maintain the equipment and facilities of the Sewer Department and regulate domestic, commercial and industrial users of the Village's sewage treatment facilities so as to protect the public health and prevent nuisances.
B. 
Prevent the introduction into the Village's sewage treatment system of pollutants which will interfere with the structural, biological or other operation of the system.
C. 
Prevent the introduction into the Village's sewerage system of pollutants which will pass through the system inadequately treated, resulting in the discharge of liquid, gases or solid discharge from the City of Glens Falls' sewage treatment facility in violation of any applicable federal, state or local standards.
D. 
Improve opportunities to recycle and reclaim the wastewater and sludge of users of the city's sewage treatment facility.
E. 
Provide for the equitable distribution of the costs of the Village's sewerage system among the users of the system.
As used in this chapter, the following terms shall have the meanings indicated:
ACCIDENTAL DISCHARGE
An unintentional discharge to the Village's sewer system by a user in violation of the terms of the user's permit.
ACT
The Federal Water Pollution Control Act, also known as the "Clean Water Act," as amended, 33 U.S.C. § 1251 et seq.
ADMINISTRATOR (also referred to as "Regional Administrator")
The Regional Administrator of Region 2 of the United States Environmental Protection Agency.
AUTHORIZED REPRESENTATIVE
A. 
A principal executive officer of at least the level of vice president if the user is a corporation.
B. 
A general partner or proprietor if the user is a partnership or sole proprietorship, respectively.
C. 
A duly authorized representative of the individual designated in Subsection A or B of this definition if such representative is responsible for the overall operation of the facility from which the discharge to the POTW originates.
BIOCHEMICAL OXYGEN DEMAND
The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure five days at 20° C. expressed in terms of weight and concentration (milligrams per liter).
BOARD
The Board of Water and Sewer Commissioners of the City of Glens Falls, New York.
BUILDING DRAIN
That part of the lowest horizontal piping of the drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet outside the interface of the building wall.
BUILDING SEWER
That part of the piping of a drainage system which extends from the end of the building drain to the public sewer or other place of disposal and which receives the discharge of the building drain and conveys it to said public sewer or other place of disposal.
CITY
The City of Glens Falls, New York.
COMMERCIAL WASTE
Wastewater produced by commercial establishments.
DIRECTOR (also referred to as "State Director")
The Commissioner of the New York State Department of Environmental Conservation or his authorized (pursuant to internal DEC procedures) agent.
DOMESTIC WASTE
Wastewater produced by domestic or residential establishments.
EXISTING INDUSTRIAL USER
An industrial user which is contributing wastewater to the Village's sewer system as of the effective date of this chapter.
GARBAGE
Solid waste from the preparation, cooking and dispensing of food and from the handling, storage and sale of produce.
GRAB SAMPLE
A sample taken from a point within the Village's sewer system on a one-time basis, with no regard to the flow in the sewer system and without consideration of time.
INDUSTRIAL USER
An establishment producing industrial wastes which are contributed to the Village's sewer system.
INDUSTRIAL WASTE
The fluid wastes from industrial or manufacturing processes, trades or businesses.
INTERFERENCE
The inhibition or disruption of the POTW treatment processes or operations or that which contributes to a violation of any term of the city's SPDES permit. The term includes but is not limited to damage to or disruption of the structural integrity of the city's and Village's sewerage system (sewage treatment facility plus appurtenant facilities and sewer lines) or the biological processes involved within the sewage treatment facility proper and the prevention of sewage sludge use or disposal by the POTW in accordance with Section 405 of the Act (33 U.S.C. § 1345) or any criteria, guidelines or regulations developed pursuant to the Solid Waste Disposal Act, the Clean Air Act, the Toxic Substances Control Act or more-stringent state or local criteria, including those contained in any state sludge management plan pursuant to Title IV of the SWDA, applicable to the method of disposal or use employed by the POTW.
LAWS
The Village of South Glens Falls local laws.
NATIONAL CATEGORICAL PRETREATMENT STANDARD
Any regulation containing pollutant discharge limits promulgated by the EPA in accordance with Section 307(b) and (c) of the Act (33 U.S.C. § 1347) which applies to a specific category of industrial users.
NATURAL OUTLET
Any outlet into a watercourse, pond, ditch, lake or other body of ground- or surface water.
NEW SOURCE INDUSTRIAL USER
Any industrial user which begins contribution to the Village's sewer system subsequent to the effective date of this chapter.
NITROGENOUS OXYGEN DEMAND
That portion of the total oxygen demand of raw sanitary wastes exerted by the autotrophic bacteria Nitrosomonas and Nitrobacter to oxidize ammonia to nitrate, as measured by the 15th Edition of Standard Methods for the Examination of Water and Wastewater.
NONCOMPATIBLE WASTE
Any wastewater which would result in interference to the city's or Village's sewerage system.
PERMITTEE
Any person who has been granted a domestic/commercial permit or an industrial wastewater discharge permit.
PERSON
Any individual, partnership, copartnership, firm, company, corporation, association, joint-stock company, trust, estate, governmental entity or any other legal entity or its legal representatives, agents or assigns. The masculine gender shall include the feminine, and the singular shall include the plural, where indicated by the context.
pH
The logarithm (base 10) of the reciprocal of the concentration of hydrogen ions expressed in grams per liter of solution.
POLLUTION
The man-made or man-induced alteration of the chemical, physical, biological and/or radiological integrity of water.
PRETREATMENT
The reduction in the amount of pollutants, the elimination of pollutants or the alteration of the nature of pollutant properties in wastewater to a less harmful state prior to discharge to the POTW, in accordance with applicable federal, state or local pretreatment standards and/or the terms of the user's industrial wastewater discharge permit. The reduction or alteration can be obtained by physical, chemical or biological processes or process changes by other means, except by dilution where dilution would be prohibited by 40 CFR 403.6(d).
PRIORITY POLLUTANT
Any substance included in the list, as amended, of priority pollutants promulgated by the United States EPA pursuant to the Clean Water Act of 1977 and the Consent Decree of N.R.D.C. vs. Train, 8 E.R.C. 2120 (D.D.C., 1976).
PRIVATE SEWAGE DISPOSAL SYSTEM
Any privy, septic tank, cesspool or other sewage disposal facility owned and operated by a person, other than the Village's sewage system.
PROPERLY SHREDDED GARBAGE
The wastes from the preparation, cooking and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than 1/2 inch in any dimension.
PUBLICLY OWNED TREATMENT WORKS
The sewage treatment facility and appurtenant facilities and sewer lines of the City of Glens Falls, overseen by the Board of Water and Sewer Commissioners. Where the context so indicates, "POTW" shall also refer to the administrative network which oversees the physical plant of the city's sewer system, presided over by the Board.
SEWAGE
A combination of water-carried wastes from domestic residences, business buildings, commercial establishments and industrial establishments, together with such ground-, surface or storm waters as may be present.
SEWAGE TREATMENT FACILITY
The physical plant, located on Shermantown Road in the City of Glens Falls, at which wastes discharged into the Village's sewerage system by all users of that system are received and treated prior to discharge into the Hudson River as liquid waste or into the sludge produced by said plant as solid waste.
SIGNIFICANT INDUSTRIAL USER
Any industrial user that is subject to a National Categorical Pretreatment Standard or is having substantial impact, either singly or in combination with other industrial users, on the operation of the POTW or is using, on an annual basis, more than 10,000 pounds or one thousand gallons of raw material containing a priority pollutant and is discharging a measurable amount of a priority pollutant to the POTW or is discharging more than 5% of the wastewater entering the sewage treatment facility.
SLUG LOADING
Any discharge of wastewater in which the concentration of any given constituent or the quantity of total flow exceeds, for period of duration longer than 15 minutes, more than five times the average twenty-four-hour concentration or flow during normal operation.
STANDARD INDUSTRIAL CLASSIFICATION
A classification pursuant to the Standard Industrial Classification Manual issued by the Executive Office of the President, Office of Management and Budget, 1972.
STATE
The State of New York.
STATE POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT
A permit issued pursuant to Section 402 of the Act (33 U.S.C. § 1342) and New York State Environmental Conservation Law Article 17, Title 8.
SUSPENDED SOLIDS
The total suspended matter that floats on the surface of or is suspended in the wastewater contributed to the Village's sewerage system by the users thereof and which is removable by laboratory filtering.
USER
Any person contributing wastewater to the Village's sewerage system.
VILLAGE
The Village of South Glens Falls, New York.
VILLAGE BOARD
The Village of South Glens Falls Board of Trustees.
WASTEWATER
The liquid and water-carried domestic, commercial or industrial wastes discharged into the Village sewerage system by the users thereof, together with any groundwater, surface water and stormwater that may be present.
WATERCOURSE
A channel in which a flow of water occurs, either continuously or intermittently.
As used in this chapter, the following abbreviations shall have the meanings indicated:
BOD —  Biochemical oxygen demand.
CFR — Code of Federal Regulations.
DEC — The New York State Department of Environmental Conservation.
EPA — The United States Environmental Protection Agency.
l — Liters.
Mg — Milligrams.
NOD — Nitrogenous oxygen demand.
O&M — Operation and maintenance.
POTW — Publicly owned treatment works.
SIC — Standard industrial classification.
SIU — Significant industrial user.
SPDES — State Pollutant Discharge Elimination System.
SS —  Suspended solids.
SWDA — Solid Waste Disposal Act.
