A. 
The following rules and regulations have been established by the Board of Trustees of the Village of South Glens Falls, hereinafter referred to as "the Village."
B. 
Each and every consumer, user or taker of water from the Village water system and owner of property in the Village shall be in all respects bound by and shall be considered to have agreed to the rules, regulations, requirements and schedules of water rates and other charges as hereinafter set forth or amended or modified by the Board of Trustees as a condition precedent to the rights of service from said water system.

C. 
Except in cases of fire, no person or persons shall take water from the fire hydrants of the Village for any purpose whatsoever without having obtained permission from the Village Superintendent of Public Works, and, in case of fire, said fire hydrants shall be opened and water shall be taken therefrom only by Village employees or active members of the Fire Department.
D. 
No alternative or private water supply shall provide service to premises in the Village, to the exclusion of municipal water where such premises are situated in the designated aquifer protection district.

E. 
No alternative water source or private potable water supply shall be mixed or commingled into the Village's municipal water system without prior written approval by the Board of Trustees.

Municipal water service to a private property shall be supplied upon the requirement that the private property owner shall be exclusively responsible for all costs, maintenance, upkeep, repair or replacement of any lateral water pipe which is a water supply conduit between the municipal shut off valve (curb stop) and the user's private property water system. The Village shall be exclusively responsible for the costs, maintenance, upkeep, repair or replacement of all municipal water mains, any municipal shut off valve (curb stop) and any municipal lateral water pipe that is a conduit for water supply from the water main, to and including the municipal water shut off value (curb stop). Notwithstanding, the Village shall not be liable on any claim for property damage, personal injury or death alleged to have been caused by inadequate municipal water supply or alleged failure to supply municipal water arising from any breakage, freezing or other circumstances of alleged defect or condition unless such claimant shall have served a prior written notification of such alleged defect or condition upon the Village Clerk Treasurer in accordance with the requirements of law.
The Village reserves the right to impose specific regulations in connection with the supply to private fire-protection systems.
A. 
Those desirous of making connections to the mains of the water system of the Village should make application for permission thereof to the Village. Nothing in this chapter shall be construed, however, as prohibiting the Superintendent of Public Works from requesting a greater charge than stipulated in the Fee Schedule[1] for connections to the Village mains when, in his opinion, conditions or other circumstances are such that a greater charge is merited. It shall be at the discretion of the Superintendent of Public Works to fix and determine the charges for this service.

B. 
No work shall be performed upon the Village mains or upon the services connected thereto between the main and the curb stop except by employees of the Village or duly authorized contractors subject to the Superintendent of Public Works' approval.
C. 
The consumer is required to notify the superintendent of Public Works of any leak occurring in or damage to the lateral line, in which case the water will be turned off at the curb stop and will remain turned off until the leak is repaired to the satisfaction of the Superintendent of Public Works. All leak repairs to the lateral line from the main shall be at the cost and the responsibility of the property owner. If any lateral line is determined by the Superintendent of Public Works to be unrepairable or is all galvanized iron or a type of rigid copper that does not meet Village specifications, at the option of the Superintendent of Public Works, the lateral pipe may be required to be replaced with a copper pipe from the main at the sole expense of the property owner. In all cases, repairs shall be made in conformity with the specifications for new services, insofar as they may be applicable. Nothing in this section shall be construed as violating any agreement heretofore entered into between property owners served through improved and accepted services and the Village.

D. 
Service shall be controlled at the curb stop and water will be charged for as long as the curb stop is open. The water shall be turned off and on only by employees of the Village of South Glens Falls or the duly authorized representatives and only upon filing proper request with said Village.
E. 
The Village shall not be liable for any damage which may result to consumers' pipes, appliances or other fixtures from the shutting off of water mains or service pipes for any purpose whatsoever, whether previous notice has been given or not. No deduction from the service charge will be made for periods when the service is shut off. In cases where coils or other devices are installed in heating boilers or separate heating devices for the purpose of providing domestic hot water, approved check and relief valves must be installed at the expense of the owner in the supply or feed pipe between the main and the source of heat. This is not only to be installed at the expense of the owner but also at his peril. The Village assumes no responsibility for the proper operation and function of said valves.
F. 
The Village shall not be held liable for any damage sustained by reason of its failure to supply water to any owner at any time or for any cause, and it reserves the right to control the amount of water supplied in the event that the supply becomes short for any reason.
G. 
The Village does not guarantee service from the street main or through the house or through any piping valves or connections therein.
H. 
All materials used, the method and manner of placing the same and the general arrangement and progress of the work shall conform to the specifications hereinafter set forth in these regulations. The minimum is three-fourths-inch Type K copper.
I. 
No street pavement opening or sidewalk cutting shall occur until after the property owner has obtained written permission from the Superintendent of Public Works or his agent.

J. 
A separate tap and service shall be installed for each premises located on a street where there is a Village water main. When or if the premises should be subdivided for residential, commercial or industrial use, each entity shall be considered a separate water user and each will be billed separately in accordance with the applicable provisions of this chapter. When the word "premises" is used herein, it shall be taken to designate a building under one roof owned or leased by one or more persons and occupied for residential, commercial or industrial use.

K. 
No connection of any kind shall be made to the service pipe between the main and the premises.
L. 
The installation of the lateral pipe from the main to the owner's premises shall be performed in conformity with the requirements of the Superintendent of Public Works or his agent. In all cases, the turning off or turning on of a curb stop shall be done only by the Superintendent of Public Works or his agent.

M. 
Where an application is made for a connection for which existing service pipe is provided to the curb box only, all work shall be performed in accordance with these rules and regulations and specifications. As far as they are applicable, the connections shall be made at the curb stop instead of at the main. It shall be the duty of the applicant or his agent to determine that the portion of the connection previously installed is in satisfactory condition and to make any repairs thereto which may be required by the Superintendent of Public Works or his representative, all of which shall be at the expense of the applicant. Detailed methods of connection to the existing service pipe shall be in accordance with the instructions of the Superintendent of Public Works or his representative. The applicant must pay for such service connection.
N. 
Where an application is made to increase the size of the service pipe or for any other change to be made in said pipe which services any consumer, the corporation cock controlling such service must be closed at the main prior to any withdrawal of water through the reconstructed service pipe.
O. 
Temporary connections. Those desiring the use of water for temporary purposes other than from temporary connections to the main shall make application to the Village setting forth, in detail, the reason and the exact use which is to be made of the water, and the Village may issue the necessary permit under such terms and conditions as it may determine.
P. 
In case it is desired to abandon a service, the Village shall be notified and the service will be disconnected at the curb stop. The work shall be performed at the expense of the owner.
Q. 
The Superintendent of Public Works shall have control of the installation, maintenance, repair and adjustment of taps, mains, curb boxes, service pipes and meters. The Village shall not be responsible for breaks, obstructions or intermission of service arising from any cause whatsoever, except that they may take such steps as are reasonable upon proper notification to make such repairs as may be necessary to restore service from the main to the curb stop.
R. 
The Village shall be the sole judge as to the meaning of these rules and regulations. Its interpretation shall be final and binding upon all applicants for water service and upon all takers and users of water.
