The annual sale of Christmas trees and holiday greens, flowers and plants is permitted between November 15 and December 31 inclusive, provided that :
A. 
The commercial sale of Christmas trees and greens shall be restricted to nonresidential zoning districts;
B. 
The sale on their own premises of Christmas trees and greens by churches, schools or other nonprofit organizations may occur in any zoning district; if any such nonprofit organizations do not own their own property in the municipality, they may sell Christmas trees and greens on property belonging to others, but in business or industrial districts only;

C. 
No trees or greens shall be displayed nearer the property line than the building setback line; however, retail establishments selling perishable holiday greens, flowers and plants inside their stores may display or store such merchandise outside on firmly anchored supports, provided that such merchandise must:
(1) 
Not project more than two feet from the front facade of the building;
(2) 
Be recessed at least six inches from each side of the retail establishment;
(3) 
Be located in such a way that a four-foot passageway for pedestrians on public sidewalks shall exist;
(4) 
Not make accessways to building entrances more narrow; or
(5) 
Not create dangerous conditions for pedestrians.
D. 
No sales or lighting of display areas shall continue after 10:00 p.m.; and
E. 
All trees, greens and displays described in this section, and debris, shall be removed before midnight on December 31.
The provisions of this chapter shall not be construed as to interfere with the temporary use of any property as a voting place in connection with a municipal or other public election.
Public utility lines for the transportation and distribution and control of water, electricity, gas, oil, steam, telegraph and telephone communications, and their supporting members, other than buildings or structures, shall not be required to be located on a lot nor shall this chapter be interpreted as to prohibit the use of a property in any zone for the above uses.
An open fireproof fire escape or stairway may project into a rear yard for a distance not to exceed eight feet.
