For the purposes of this Part 1, the terms used herein are defined as follows:
COMPREHENSIVE PLAN
The Comprehensive Plan, prepared by the Planning Board pursuant to § 272-a of the Town Law, which indicates the general locations recommended for various functional classes of public works, places and structures and for general physical development of the Town, and includes any unit or part of such plan separately prepared and any amendment to such plan or parts therein.

CONSTRUCTION DETAIL PLANS
Engineering drawings prepared by a licensed engineer showing details and results of engineering designs for proposed improvements.
DIRECTOR OF PLANNING
The duly designated Director of Planning for the Town of Yorktown.
EASEMENT
Authorization by a property owner for the use by another, and for a specified purpose, of any designated part of his property.
ENGINEER, PROFESSIONAL ENGINEER or LICENSED PROFESSIONAL ENGINEER
A person licensed as a professional engineer by the State of New York.
INTERESTED PARTIES
The owner or owners of property immediately adjoining or abutting the parcel or parcels to which an action, as herein defined, is contemplated. Properties on the opposite side of a road running along said parcel shall also be notified, and/or any other party otherwise designated as an interested party by the Planning Board.

MAJOR SUBDIVISION
Any subdivision not classified as a minor subdivision, including but not limited to a subdivision of six or more lots or any size subdivision requiring any new street.
MINOR SUBDIVISION
Any subdivision of a tract of land containing not more than five lots, fronting on an existing street, not involving any new street or road, not adversely affecting the development of the remainder of the parcel or adjoining properties and not in conflict with any provision of or portion of the Comprehensive Plan, Official Map, Chapter 300, Zoning, or this Part 1.
OFFICIAL MAP
The map established by the Town Board pursuant to § 270 of the Town Law, showing streets, highways, parks and drainage, both existing and proposed.
PLANNING BOARD or BOARD
The Planning Board of the Town of Yorktown.
PRELIMINARY PLAT
A drawing or drawings clearly marked "preliminary plat" showing the salient features of a proposed subdivision, as specified in Article V, § 195-26, of this Part 1, submitted to the Planning Board for purposes of consideration prior to submission of the "plat in final form" and of sufficient detail to apprise the Planning Board of the layout of the proposed subdivision.
PUBLIC HEARING
A hearing conducted for the purposes of eliciting input from the public and acquiring information or evidence which will be considered in evaluating an application and which will produce a record that is to be the basis for decision-making action by the approval authority; the "public hearing" contemplated by § 274-a, 276, and 277 of the New York State Town Law.

PUBLIC INFORMATIONAL HEARING
An informal, nonadjudicatory meeting conducted primarily for the purpose of informing the community about the proposed project and neither intended nor designed to produce a record that is to be the basis of decision-making action by the approval authority; not the "public hearing" contemplated by §§ 274-a, 276, and 277 of the New York State Town Law.

SECRETARY TO PLANNING BOARD
The duly authorized Secretary to the Planning Board of the Town of Yorktown.
STREET
Streets, roads, avenues, lanes or other trafficways, between right-of-way lines.
STREET, COLLECTOR
A street which serves or is designed to serve as a trafficway for a neighborhood or as a feeder to a major street.
STREET, DEAD-END OR CUL-DE-SAC
A street or a portion of a street with only one vehicular traffic outlet.
STREET, HALF
A street paralleling the boundary of a subdivision and lying partly in an abutting tract.
STREET, MAJOR
A street which serves or is designed to serve heavy flows of traffic and which is used primarily as a route for traffic between communities and/or other heavy traffic generating areas.
STREET, MINOR
A street intended to serve primarily as an access to abutting properties.
STREET PAVEMENT
The wearing or exposed surface of the roadway used by vehicular traffic.
STREET RIGHT-OF-WAY WIDTH
The width of right-of-way, measured at right angles to the center line of the street, and includes all lands between property lines.
SUBDIVIDER
Any person, firm, corporation, partnership or association who shall lay out any subdivision or part thereof as defined herein, either for himself or others.
SUBDIVISION
The division of any parcel of land, as it existed on March 1, 1966, as shown on the Town tax maps and irrespective of the period of time of which said division of land is made, into two or more lots, plots, sites or other division of land for the purpose whether immediate or future of the transfer of ownership or of building development and which shall include resubdivision as defined in § 276 of the Town Law. A division of a parcel of land for the purpose of transfer of ownership, however, shall not be considered a subdivision if such division and transfer does not create one or more new lots or sites for building or development and/or does not reduce the size or dimension of any parcel remaining after such transfer in such a way as to create or to increase any nonconformity to the requirements of Chapter 300, Zoning.
SUBDIVISION PLAT or FINAL PLAT
A drawing, in final form, showing a proposed subdivision containing all information or detail required by law and by this Part 1 to be presented to the Planning Board for approval, and which if approved may be duly filed or recorded by the applicant in the office of the County Clerk or Register.
SURVEYOR or LAND SURVEYOR
A person licensed as a land surveyor by the State of New York.
TOWN ENGINEER
The duly designated engineer of the Town of Yorktown.
ZONING ORDINANCE
The officially adopted Zoning Ordinance of the Town of Yorktown, including all amendments thereto as of the date of consideration, known as Chapter 90 of this Code.
