There is hereby established a chapter to regulate
the hours and use of Town parks and recreation facilities for the
protection and promotion of the public health, safety and general
welfare of the residents of the Town of Yorktown, such chapter in
all respects to apply to the special district known and designated
as the "Mohegan Beach Park District."

The Town Board of the Town of Yorktown finds as a fact that
the rapid growth of the Town has placed a burden upon the Town's
parks, beaches and other recreational facilities and accordingly restricts
the use of said parks, beaches and recreation facilities to the residents
and/or taxpayers of the Town of Yorktown and their bona fide houseguests
in such numbers as may from time to time be limited and under such
circumstances as authorized by the Town Board, and each resident and/or
taxpayer shall be required to display an authorized identification
which may be obtained at the office of the Department of Parks and
Recreation. A permit may be issued by the Department of Parks and
Recreation, the fee for which shall be in an amount as set forth in
the Master Fee Schedule.
No person shall injure or destroy any building,
equipment, sign or grounds owned and maintained by the Town of Yorktown.
Picnics and/or other food consumption will be
permitted only in areas so designated by the Superintendent. Sponsors
of organized picnics or parties must obtain a suitable permit from
the Parks and Recreation Department prior to arrival at and use of
the picnic area.
No person shall fail, neglect or refuse to comply
with or obey the lawful direction or command of any member of the
Yorktown Police Department, the Yorktown Auxiliary Police, personnel
of the Parks and Recreation Department or other duly authorized personnel
or fail, neglect or refuse to comply with or obey any instruction,
direction, regulation, warning or prohibition written, printed or
displayed in any park, beach or other recreational facility. The directions
of any posted regulations may be disregarded only on order of Town
police officers, Yorktown auxiliary police officers or Park and Recreation
Department personnel.
No person shall build a fire except in places
so provided for by the Town. Any fire shall be continuously under
the care of a competent person over 21 years of age.

A. No person
shall ice skate, sled, walk or go upon any ice or snowshoe or ski
on any Town property except at such times and upon such places as
may be designated for such use and until such ice is declared by or
under the authority of the Superintendent to be in safe condition.
B. No towing
of persons on skis, sleds, ice skates shall be allowed.
No privately owned boats, rafts or other artificial
means of support on water shall be allowed entry upon Town-owned waters
and parks, except for emergency purposes.

A. No person shall allow, permit or cause any firearms
to be discharged in, over or into a Town park or recreational facility
or within 500 feet of any Town park.
B. It shall not be a violation of this provision for
a peace officer to discharge his/her weapon within the scope of his/her
official duties, nor shall it be a violation of this provision to
discharge a firearm within the scope of an official ceremonial function.
Any person committing an offense against any
provision of this chapter shall be guilty of a violation punishable
by imprisonment for a term not exceeding 15 days or by a fine not
exceeding $250, or by both such fine and imprisonment. The continuation
of an offense against the provisions of this chapter shall constitute,
for each day the offense is continued, a separate and distinct offense
hereunder.
