Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383, N.J.S.A. 52:27D-202), the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1 et seq.) shall be locally enforced in the City of Bridgeton.
The local enforcing agency shall be the City of Bridgeton Fire Department through its Bureau of Fire Prevention which is hereby created therein. The Bureau of Fire Prevention shall hereinafter be known as the local enforcing agency.
A. 
The local enforcing agency shall enforce the Uniform Fire Code in all buildings, structures, and premises within the established boundaries of the City of Bridgeton other than one- and two-unit owner-occupied dwellings used exclusively for dwelling purposes and buildings, structures, and premises owned or operated by the federal government, interstate agencies or the state.
B. 
The local enforcing agency shall faithfully comply with all the pertinent requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
A. 
The Bureau of Fire Prevention established by § 162-2 of this article shall be under the direct supervision and control of a Fire Official who shall report to the Chief of the Fire Department.
B. 
The Bureau of Fire Prevention shall have at least one paid inspector.
A. 
Appointment and qualifications of Fire Official. The Fire Official shall be certified by the state and hired by the Business Administrator with approval of the Mayor.
B. 
Appointment and qualifications of inspectors and other employees. Inspectors and other employees of the enforcing agency shall be hired by the Business Administrator with the approval of the Mayor upon recommendation of the Fire Official. All life hazard use inspectors shall be certified by the state.
C. 
Appointment of legal counsel. The governing body shall specifically appoint legal counsel to assist the agency in enforcing the Uniform Fire Code.
D. 
Term of office. The Fire Official shall serve for a term of three years. Any vacancy shall be filled for the unexpired term.
E. 
Removal from office. The Fire Official, inspectors and other employees of the agency shall be subject to removal by the Business Administrator for just cause. Before removal from office, all persons shall be afforded an opportunity to be heard by the governing body or a hearing officer designated by the same.
The Bureau of Fire Prevention established by § 162-2 of this article shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.

In addition to the registrations required by the Uniform Fire Code, the following non-life-hazard uses shall register with the Bureau of Fire Prevention. These uses shall be inspected once per year and shall pay an annual fee as set forth in Chapter 149, Fees, Article II, Schedule of Fees.
B. 
R-A uses shall be inspected and charged a fee only upon sale or change of tenant.
C. 
Uses not classified above that are subject to code will be classified as business uses.
D. 
Uses required to register with the state as life hazard uses shall not be required to register under this section.
E. 
In the discretion of the Fire Official, vacant buildings will be charged and inspected according to the previous use of the building.
F. 
All residential uses except R-A uses shall be inspected in the common areas only.

The application fees for the permits listed in N.J.A.C. 5:70 shall be as provided current state regulations for the following type application and permit:

B. 
The cost issuance of a Certificate of Fire Code Status shall be as set forth in Chapter 149, Fees, Article II, Schedule of Fees.
C. 
Smoke detectors and carbon monoxide alarms shall be inspected by the Division of Housing and Code Enforcement within the City limits of the City of Bridgeton, in accordance with N.J.A.C. §5:70-4.19 et seq, and certificates of approval with respect to operation thereof shall be issued by the Division of Housing and Code Enforcement as required. The approval or denial of a certificate with respect to the operation of such devices shall be undertaken by the Division of Housing and Code Enforcement of the City of Bridgeton, notwithstanding the provisions of Chapter 265 or Chapter 267 of the Code of the City of Bridgeton to the contrary.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act (N.J.S.A. 52:27D-206 and 52:27D-208), any person aggrieved by an action of the local enforcing agency shall have the right to appeal to the local Construction Board of Appeals. If no such body exists, appeals shall be made to the County Construction Board of Appeals.
Enforcement and violations and penalties shall be managed in conformity with the Uniform Fire Safety Act, and Uniform Fire Code and all other laws of the State of New Jersey.
