Editor's Note: Ordinance No. 2003-19, adopted 12-15-2003, provided, in part, as follows:
Section 1. The Planning Board and Zoning Board of Adjustment of the Borough of Clementon are hereby dissolved and the terms of all members of the existing Planning Board and Zoning Board of Adjustment shall expire effective December 31, 2003.
Section 2. A new nine-member Planning Board, with four alternate members, is hereby created pursuant to N.J.S.A. 40:55D-25c. Members of the new Combined Planning Board shall be appointed by the Mayor at the reorganization meeting in January 2004.

Pursuant to the provisions of Section 40:55-1.4 of the Revised Statutes (Chapter 433 of the Laws of New Jersey 1953) the Joint Land Use Board of the Borough of Clementon is hereby increased from five members to nine members.

The members shall consist of, and be divided into, for convenience in designating the manner of appointment, the four following classes:
Class I—Mayor, ex officio.
Class II—One of the officials of the municipality, to be appointed by the Mayor.
Class III—A member of the governing body, to be appointed by it.
Class IV—Six other citizens of the municipality to be appointed by the Mayor.

The term of the member composing Class I shall correspond to the Mayor’s or Manager’s official tenure or, if the member is the Mayor’s designee in the absence of the Mayor, the designee shall serve at the pleasure of the Mayor during the Mayor’s official tenure. The terms of the members composing Class II and Class III shall be for one year or terminate at the completion of their respective terms of office, whichever occurs first, except for a Class II member who is also a member of the Environmental Commission. The term of a Class II or Class IV member who is also a member of the Environmental Commission shall be for three years or terminate at the completion of the term of office as a member of the Environmental Commission, whichever occurs first. The term of a Class IV member who is also a member of the Board of Adjustment or Board of Education shall terminate whenever he is no longer a member of such other body or at the completion of his Class IV term, whichever occurs first. The terms of all Class IV members first appointed under this article shall be so determined that to the greatest practicable extent the expiration of such terms shall be distributed evenly over the first four years after their appointments, provided that the initial Class IV term of no member shall exceed four years. Thereafter, the Class IV term of each such member shall be four years. If a vacancy in any class shall occur otherwise than by expiration of the Joint Land Use Board, it shall be filled by appointment, as above provided, for the unexpired term. No member of the Joint Land Use Board shall be permitted to act on any matter in which he has, either directly or indirectly, any personal or financial interest. Any member other than a Class I member, after a public hearing if he requests one, may be removed by the governing body for cause.

The Joint Land Use Board is authorized to adopt bylaws governing its procedural operations. It shall elect a Chairman from the members of Class IV, create and fill such other offices as it may determine. It may employ experts and a staff and pay for their services and for such other expenses as may be necessitated and proper, not exceeding in all, inclusive of gifts, the amount appropriated by the governing body.

The Mayor may, in his discretion, following the organization of the Joint Land Use Board, appoint a Citizens' Advisory Committee to represent the civic and other organization of the Borough of Clementon and to collaborate with the Joint Land Use Board in its studies, which Committee shall elect its own officers and determine its procedure.

It shall be the function and duty of the Joint Land Use Board to make and adopt a Master Plan for the physical development of the municipality, including any areas outside of the boundaries of said Borough of Clementon. Such plan in all respects shall comply with and take into consideration the matters mentioned and contained in Section 40:55-6 of the Revised Statutes.

The Joint Land Use Board so established and its successors in office are hereby authorized to adopt regulations governing the subdivision of land within its jurisdiction, to approve plats showing new streets or highways and to determine and fix the minimum size of lots and to establish building lines, except where the same have already been established by the Zoning Ordinance of Borough of Clementon[2] as provided by Section 40:55, etc., of the Revised Statutes.

The Joint Land Use Board shall exercise to the same extent and subject to the same restrictions all the powers of the Zoning Board of Adjustment; but the Class I and the Class III members shall not participate in the consideration of applications for development which involves relief pursuant to N.J.S.A. 40:55D-70d.
