No person or persons, firm, association or corporation
owning, leasing, managing, conducting or operating any establishment
within the village wherein food or drink is sold or given away or
offered for sale shall permit or suffer any dancing, cabaret show
or other exhibition, amusement, performance or entertainment therein
without first procuring a license for such dancing, cabaret show or
other exhibition, amusement, performance or entertainment. Nor shall
any person or persons, firm, association or corporation owning, leasing,
managing, conducting or operating any theater, dance hall or place
of amusement in the village permit any dancing, cabaret show or other
exhibition or performance therein without first procuring a license
therefor.
Any applicant for such license shall apply,
in writing, to the Superintendent of the Building Department of the
village for the issuance of a license. The application for such license
shall state in detail the nature of the dancing, cabaret show or other
exhibition, amusement, performance or entertainment for which a license
is desired, the location of the building wherein the same is to be
conducted or permitted and the name of the person or persons, firm,
association or corporation which desires to conduct such dance, cabaret
show or other exhibition, amusement, performance or entertainment.
Said application must specify the residence of the persons comprising
any such firm, association or corporation and the particular place
of business of any such corporation and the name of the officer, in
the case of a corporation, upon whom process or other legal notice
may be served within the village.
The fee for any license required by the provisions
of this article shall be at the levels fixed from time to time by
resolution of the Board of Trustees of the Village of East Rockaway.
The following organizations shall be exempt
from license fees as prescribed in this article: all schools licensed
by the New York State Department of Education, religious institutions,
the East Rockaway Fire Department and any recognized association of
war veterans.
Any person or persons, firm, association or
corporation violating any provision of this article shall be liable
for and forfeit and pay a penalty of $2,500 for each violation thereof,
for the use of said village; and it is further ordained and enacted
that the violation of any of the provisions of this article shall
constitute disorderly conduct, and the person so violating the same
shall be and is hereby declared a disorderly person.
