The Superintendent of Construction of the Village
of East Rockaway shall not issue any permit or approve the plans and
specifications for the construction of any multiple-family dwelling,
apartment house, hotel, commercial structure, industrial plant or
establishment containing more than 1,500 square feet (Any structure
containing store units of less than 1,500 square feet each are specifically
excepted.), halls, churches, temples, clubhouses, lodge halls and
places of public assembly, until the owner or applicant for a permit
has set forth in writing the method in which garbage, trash and other
refuse shall be disposed of and, if by incinerator, a detailed plan
of such incinerator. Accompanying the statement as to disposal of
the garbage, trash and refuse shall be a sketch or layout showing
where such garbage, trash and refuse will be accumulated before it
is picked up by Village trucks of the Department of Public Works or
a private collector.

A charge shall be made for the collection of
all garbage, trash and refuse to be removed or collected by the Department
of Public Works of the Village of East Rockaway from multiple-family
dwellings, apartment houses, hotels, commercial structures, industrial
plants or establishments containing more than 1,500 square feet, halls,
churches, temples, clubhouses, lodge halls and places of public assembly
or other premises within the Village of East Rockaway. The person,
firm, association or corporation owning, occupying or using the premises
from which said garbage, trash and refuse has been removed shall be
required to pay to the Village of East Rockaway at a rate set forth
by the Board of Trustees.

In determining the weight, the Department of
Public Works shall compute the amount and quantity of garbage, trash
and refuse removed from the premises by weighing such garbage each
month or more frequently at the discretion of the Superintendent of
Public Works, if he deems it necessary to arrive at an average figure
in order to determine the charge to be made for the weight of the
garbage, trash and refuse removed.

Any person, persons, firm, association, copartnership
or corporation occupying, using or conducting business at any of the
premises hereinabove referred to who shall request or permit the Department
of Public Works of the Village of East Rockaway to remove garbage,
trash or refuse from his, their or its premises and does not pay the
charges therefor as hereinabove set forth will be guilty of a violation
of this article and be subject to the penalties hereinafter provided.
Any person committing an offense against any
provision of this article shall, upon conviction thereof, be guilty
of a violation pursuant to the Penal Law of the State of New York,
punishable by a fine not exceeding $250 or by imprisonment for a term
not exceeding 15 days, or by both such fine and imprisonment. The
continuation of an offense against the provisions of this article
shall constitute, for each day the offense is continued, a separate
and distinct offense hereunder.
