For the purpose of these regulations, certain words and terms used herein are defined as follows:
APPORTIONMENT
The rearrangement of lot lines for the convenience of two abutting lot owners, where no new building lot is created and no feature listed in the Table of Regulations in Chapter 197 is made nonconforming or more nonconforming.

AREA OF SPECIAL FLOOD HAZARD
The land in the floodplain within the City of Rye subject to a one-percent or greater chance of flooding in any given year, as shown on the Flood Boundary and Floodway Map as being within the one-hundred-year-flood boundary.

BASE FLOOD
The flood having a one-percent chance of being equaled or exceeded in any given year, as shown on the Flood Boundary and Floodway Map.

BEST MANAGEMENT PRACTICES
Procedures and methods pertaining to construction activities which are intended to minimize water pollution, retain valuable topsoil and prevent erosion and sedimentation, such as those practices contained in the Westchester County Best Management Practices Manual Series.

BEST MANAGEMENT PRACTICES MANUALS
The manuals published by the County of Westchester and amended from time to time, containing best management practices and entitled, "Construction Related Activities, Standards and Specifications, Westchester County New York Best Management Practices Manual Series" and "Storm Water Management Westchester County New York Best Practices Manual Series."

CITY DEVELOPMENT PLAN
A comprehensive plan for development of the city prepared and adopted by the Planning Commission pursuant to Article 3, § 28a, of the General City Law, and includes any part of such plan separately adopted and any amendment to such plan or parts thereof.
CITY STANDARDS AND SPECIFICATIONS
Standards and specifications approved by the City Engineer for the construction of streets and improvements customarily provided in street rights-of-way.
CONSTRUCTION PLAN
The maps or drawings accompanying a subdivision plat and showing the specific location and design of improvements to be installed in the subdivision in accordance with the requirements of the Planning Commission as a condition to the approval of said plat.
EASEMENT
Authorization by a property owner for the use by another, and for a specified purpose, of any designated part of this property.
ENGINEER
A civil engineer licensed as a professional engineer by the State of New York.
EROSION AND SEDIMENT CONTROL PLAN
A drawing prepared by a New York State licensed professional engineer showing the proposed use of the site and showing the methods, techniques and improvements, both during and after construction, that will be employed to control erosion and sedimentation, which shall employ best management practices.

FLOOD BOUNDARY AND FLOODWAY MAP
The official map on which the Federal Insurance Administrator has delineated the area of special flood hazard and the regulatory floodway in the City of Rye, effective April 1, 1980, and as amended.

LANDSCAPE ARCHITECT
A landscape architect licensed as a professional architect by the State of New York.

OFFICIAL MAP
The map established by the Common Council under Article 3, § 26, of the General City Law, showing the streets, highways and parks theretofore laid out, adopted and established by law, and any amendments or additions thereto adopted by the Common Council, or additions thereto resulting from the approval of subdivision plats by the Planning Commission and the subsequent filing of such approved plats.
OFFICIAL SUBMITTAL DATE
The date on which a subdivision plat is officially submitted to the Planning Commission pursuant to Article 3 of the General City Law, and hereby defined as the date of the next regular meeting of the Planning Commission following completion of the application procedure outlined in § 170-7 of these regulations. If a meeting is not called within 30 days of completion of such procedure, the "official submittal date" shall be considered to be the expiration date of such thirty-day period.
PLANNING COMMISSION
The Planning Commission of the City of Rye.
PLAT
See "subdivision plat."
PRELIMINARY LAYOUT
The preliminary drawing or drawings described in § 170-20 of these regulations, indicating the proposed manner or layout of the subdivision to be submitted to the Planning Commission for its consideration.
STREET
Includes streets, roads, avenues, lanes or other ways shown on the Official Map between right-of-way lines.
STREET, BUSINESS
A street which serves or is designed to serve as an access to abutting business properties.
STREET, DEAD-END
A street or a portion of a street with only one vehicular traffic outlet.
STREET, LOCAL RESIDENTIAL
A street intended to serve primarily as an access to abutting residential properties.
STREET, MAJOR
A street which is used primarily as a route for traffic between communities or large areas.
STREET PAVEMENT
The wearing or exposed surface of the roadway used by vehicular traffic.
STREET, SECONDARY
A street which serves or is designed to carry traffic from local residential streets to the system of major streets.
STREET WIDTH
The distance between property lines measured at right angles to the center line of the street.
SUBDIVIDER
Any person, firm, corporation, partnership or association who shall lay out, for the purpose of transfer of ownership or development, any subdivision or part thereof as defined herein.
SUBDIVISION
The division of any parcel of land into two or more lots, plots, sites or other divisions of land, for the purpose, whether immediate or future, of transfer of ownership or building development, and includes resubdivision. A division of a parcel of land for the purpose of transfer of ownership, however, shall not be considered a "subdivision" if such division and transfer does not create one or more new lots or sites for building or development and does not reduce the size or dimensions of any parcel remaining after such transfer in such a way as to create or to increase any nonconformity to the requirements of the Building Zone Ordinance.[1]

SUBDIVISION PLAT
The final map or drawing, described in § 170-21 of these regulations, on which the subdivider's plan of subdivision is presented to the Planning Commission for approval, and which, if approved, may be submitted to the County Clerk for recording; may also be referred to as "plat" in the text of these regulations.
SURFACE WATER CONTROL PLAN
A drawing prepared by a New York State licensed professional engineer showing the methods, techniques and improvements, both during and after construction, that will be employed to control surface water runoff, and shall contain all surface water control calculations, unless set forth in an accompanying document.

SURVEYOR
A person licensed as a land surveyor by the State of New York.
TREE PRESERVATION PLAN
The map accompanying a subdivision plat and showing the species, size and location of all trees 10 inches or more in caliper, identifying those trees which must be preserved and those trees which may be removed and the location, size and species of trees which will be installed in accordance with the requirements of the Planning Commission as a condition of approval of said plat.

ZONING ORDINANCE
The officially adopted Building Zone Ordinance of the city, together with any and all amendments thereto.
