The following zones, to be known as "off-street
parking meter zones," are hereby established:
A. Off-street public parking areas maintained by the
City of Rye on City-owned lands known and designated as "Parcels 3
and 4" on the Map of Property to be Conveyed to the City of Rye, surveyed
in possession, May 12, 1952, Russell Munson, Surveyor, 11 William
Street, White Plains, New York, revised October 15, 1952, also including
the area known and designated as "that part of Parcel 5 which extends
from Second Street to Third Street on the northerly side of the police
station and the Rye Station Garage," including such part of leased
area abutting and adjoining the same to the north known and designated
as "Parcel 5" on a certain map entitled "Map of Property to be Conveyed
to the City of Rye, surveyed as in possession, May 12, 1952, Russell
Munson, Surveyor, 11 William Street, White Plains, New York, revised
October 15, 1952," and also the leased area shown on a map entitled
"Map of Property to be Leased by the City of Rye, Westchester County,
New York, surveyed as in possession, June 16, 1952, Russell Munson,
Surveyor, 11 William Street, White Plains, New York, last revised
March 31, 1953," copies of said maps being on file in the office of
the City Clerk.
B. Off-street parking areas maintained by the City of
Rye on City-owned lands known and designated as "Lot No. 4" on the
Map of Village Lots near Rye Station, the Property of Jas. Padgham,"
filed in the office of the County Clerk of Westchester County, Division
of Land Records, as Map No. 616, said property being known and designated
on the Tax Map of the City of Rye as "Sheet 146.07, Block 1, Lot 15
and Lot 18," situated on the easterly side of First Street, between
Purdy Avenue and Depot Plaza in said City of Rye.
C. Off-street parking areas maintained by the City of
Rye on City-owned lands known as Car Park No. 1, Car Park No. 2, Car
Park No. 3, Car Park No. 4 and Car Park No. 5.

Parking meters shall be installed in all parking meter zones. The parking meter fee and time limits of meter operation shall be posted on each meter as prescribed in §
191-39.

When any vehicle shall be parked in a space regulated by a parking
meter, the operator thereof shall, upon entering such space, park
such vehicle within the lines marked on the street, curb or parking
area and, if the time is between the hours of 7:00 a.m. and 7:00 p.m.
or between the hours of 9:00 a.m. or 9:00 p.m. in the off-street parking
areas maintained by the City of Rye on City-owned lands known as Car
Park No. 1, Car Park No. 2, Car Park No. 3, Car Park No. 4 and Car
Park No. 5 on any day except Sunday, immediately deposit the parking
meter fee in the parking meter regulating such space and actuate the
mechanism of such meter as required by the directions thereon.

The permitted parking time and fees in all City
parking meter zones shall be set after public hearing by resolution
by the City Council. Upon the expiration of the permitted parking
time with respect to any vehicle in such designated parking space,
the operator shall forthwith remove such vehicle from such parking
space.

The fact that, at any time during any period
in which the deposit of the parking meter fee in any parking meter
is required to permit parking in the parking space regulated thereby,
the timing device on such parking meter indicates no unexpired time
shall be presumptive evidence, as to a parked vehicle then found in
such parking space, that the operator of such vehicle failed to deposit
or to cause to be deposited the required parking meter fee in such
meter or failed to remove such vehicle from such parking space upon
the expiration of the lawful parking time with respect thereto.

It shall be unlawful for any person willfully
to deface, injure, tamper with, break, destroy or impair the usefulness
of or open without lawful authority any parking meter installed in
any parking meter zone or deposit or cause to be deposited in any
such parking meter any slug, device or substitute for the parking
meter fee.

No person shall use any off-street public parking
area maintained by the City of Rye for the regular storage of an automobile
or other vehicle at night, holidays or on Sundays.
Notwithstanding the provisions of this article,
any act or omission which otherwise would be a violation of a provision
of this chapter shall not be such a violation if it was directed by
a police officer or an officer of the Fire Department.

Violation of §
191-41 shall be punishable by a fine not exceeding $300.
