All landowners owning real estate, whether or not occupied, situate in Independence Township, Washington County, Pennsylvania, that abuts any highway, street, road or alley that has public streetlighting shall pay an annual assessment in proportion to the number of feet that the subject property fronts on the street, highway, road or alley for which public lighting has been supplied. Said assessment shall be based on the pro rata cost based on all front footage within the subject district.
A. 
Six separate lighting districts are hereby created and/or ratified and are designated as follows with the present base rate:
(1) 
Avella Downtown 0.83.
(2) 
Avella Heights 0.53.
(3) 
Avella Proper 0.53.
(4) 
Duquesne 0.63.
(5) 
Independence 0.39.
(6) 
PNW 0.62.
B. 
There shall be a separate assessment for the landowners in each specific district which shall be based on the total cost incurred by the Township pertaining to such specific district as billed to the Township by the electric company or companies, which shall then be prorated among the landowners in each specific district with a flat assessment based on the first 50 feet of abutment and/or adjoining distance and the remaining distance shall be assessed on a pro rata basis so as to cover the entire amount of costs and expenses incurred by the Township for the specific district.
C. 
Said rates and/or assessments may be changed by resolution of the Board of Supervisors.
No assessment shall be made against any farmland, but vacant lots between built-up sections, either tilled or not tilled, are not farmland. The assessment for each front foot against vacant lots shall be in conformity with the Municipal Code.
All assessments shall be billed by the Township Tax Collector in conjunction with the annual real estate taxes billing, and all payments shall be paid over to the Township Treasurer.

Failure to make payment shall result in the imposition of late fees, attorney's fees, and any and all costs associated with the collection of the amount(s) due and therein any delinquency shall be posted as a lien against the subject premises and/or landowners.
