The schedule of charges for sewer service set forth in § 134-3 is adopted as the basic rate schedule of charges to be imposed, billed and collected from the owner of or user of water in each property served by the sewer system leased by the Borough from the Municipal Authority of the Borough of Baldwin, Allegheny County, Pennsylvania.
The sewer rentals and penalties hereby imposed shall be a lien
on the property served, and all delinquent bills therefor shall be
entered as a lien against such property, and such lien shall be filed
in the office of the Prothonotary of Allegheny County, Pennsylvania,
and collected in the manner provided by law for the filing and collection
of municipal liens.
A.
The Borough of Baldwin does hereby impose upon users of the sewer
system of the Borough of Baldwin the following basic rates and charges:

Basic rate per unit per month: $3 per unit.
(2)
Per 500 gallons, or fraction thereof, of water used per month: $3.22.
(3)
Per 1,000 gallons: $12.52.

B.
The charges in Subsection A are subject to the following terms and conditions:
(1)
For the purpose of determining charges to be imposed, billed and
collected pursuant to the above race schedule, the term "unit" as
employed in this article is defined to mean a single-family dwelling
or each separate apartment or dwelling unit in a multiple-family or
apartment or double house or each store, restaurant, office, shop
or similar commercial establishment, irrespective of whether the same
is individually located or constitutes a part of a larger shopping
center building or kindred structure.

Consumers with private springs, private wells or other unmetered
water sources will pay a flat rate annual charge of $50 or install
a meter at their own expense.
(4)
Any charges imposed by the Pleasant Hills Authority or the Allegheny
County Sanitary Authority for the nature or characteristic of the
sewage, for example, the BOD demand, the suspended solids or similar
commercial or industrial wastes, etc., will be assessed, at a rate
in conformity with said charge, to the Baldwin consumers contributing
such sewage.
(5)
Metered water which is not discharged to the sanitary sewerage system
may be distinguished from metered water that is discharged to the
sanitary sewerage system by the installation of an additional meter
or meters at the consumer's expense. Such nonsanitary wastewater will
not be subject to the above rate schedule when so metered. No meter
shall be installed or used for such purpose without the prior approval
of the Municipal Authority of the Borough of Baldwin.

That sewage bills shall be issued each month. All sewer usage charges
billed shall be payable on or before the due date as stated on the
bill. After such due date, the bill shall be deemed delinquent and
a penalty of 10% shall be added to the sewer usage charges for that
given monthly usage period. Interest, at the rate of 10% per annum,
shall accrue on the day after the due date and shall be computed on
both the amount of the sewer usage charges bill added to the amount
of the penalty. All unpaid sewer fees, charges and/or assessments,
together with penalty, interest, costs, fines, expenses and fees,
including reasonable attorney fees, shall become a lien on the realty
charged with the payment thereof and shall remain a lien until fully
paid and satisfied.

Where there exists no public sanitary sewer to provide service to
the basement area of a unit and the Borough Engineer has certified
to the Borough that flow by gravity from the basement area to the
existing sanitary sewer main servicing those floors above the basement
area is for all practical purposes not feasible, then there shall
be granted said consumer or user a thirty-three-and-one-third-percent
reduction in the total amount of the sewage service charge as computed
under the basic rate schedule.
