Except as otherwise provided in this Article, a person shall be in violation of this Part
2 if he or she:
A. Does or commits any act prohibited by the terms of this Part
2;
B. Does or commits any act for which a license is required,
without having secured and being in possession of a valid license,
permit or certificate at the time of the doing or commission thereof;
C. Omits to do or perform any act required by him or her to be so done or performed by this Part
2;
D. Maintains any place, establishment, vehicle, conveyance,
equipment or article in violation of any of the provisions thereof;
E. Violates any of the provisions of any of the several
Articles or sections hereof;
F. Fails to maintain any condition, equipment or facility
required therein to be maintained; or
G. Fails to install any article of a particular type,
kind, quality or specification, where such installation is required.
Unless another penalty is specifically provided;
A. Any person who shall violate any of the provisions of this Part
2 or who shall fail to comply therewith or with any of the requirements shall be punishable by a fine of not less than $5 or more than $100 for the first offense, and upon conviction of a subsequent violation within a period of six months, the court may impose a fine of not less than $10 or more than $500 for each such subsequent conviction.
B. The violation of any section or subsection of this Part
2 shall constitute a separate and distinct offense independent of the violation of any other section or subsection or of any order issued pursuant to this Part
2.
Each day a particular violation continues shall
constitute a separate offense.
In the event that any violation of this Part
2 shall also be a violation of the New Jersey State law for which a greater penalty or judgment is provided than that contained in this Part
2, the Municipal Judge or Trial Judge before whom any complaint is brought, based upon such violation, shall, in his or her discretion, have the right to impose, in the place and in lieu of any penalty provided for herein, that so provided for in the New Jersey State law which has been so violated.
Every act herein designated as being unlawful
is hereby prohibited, and every act herein expressly prohibited is
hereby designated as being unlawful.
