This article is for the purpose of regulating
the sale of alcoholic beverages in the Borough of Closter, County
of Bergen, in accordance with the provisions of the Act of the Legislature
of the State of New Jersey entitled "An Act Concerning Alcoholic Beverages,"
being Chapter 436 of the Laws of 1933, and supplements and amendments thereto, and in accordance
with rules and regulations issued or to be promulgated by the State
Commissioner of Alcoholic Beverage Control. All applications and licenses
under this article and proceedings in connection therewith shall be
subject to said Act and said rules and regulations and any laws to
be hereafter enacted.
The Mayor and Council of the Borough of Closter
shall constitute the authority for the administration of the issuance
of licenses under this article, and it shall be unlawful to sell or
distribute alcoholic beverages in the Borough of Closter without a
license granted under the provisions of said Act.

The annual fee for a plenary retail consumption license shall be as set forth in Chapter
A301, Fees and Deposits, and the holder of such license shall be permitted to sell for consumption on the premises any alcoholic beverage by open receptacle and also to sell alcoholic beverages in original containers for consumption off the premises, according to the provisions of law; provided, however, that the issuance of plenary retail consumption licenses shall be limited to nine applicants.

The annual fee for a plenary retail distribution license shall be as set forth in Chapter
A301, Fees and Deposits, and the holder of such license shall be permitted to sell alcoholic beverages for consumption off the licensed premises in original containers, subject to rules and regulations; provided, however, that the issuance of plenary retail distribution licenses shall be limited to three applicants.

The annual fee for a club license shall be as set forth in Chapter
A301, Fees and Deposits, and the holder of such license shall be entitled to sell only to bona fide club members and their guests alcoholic beverages intended for immediate consumption on the licensed premises, and to be issued in accordance with the provisions and laws of the State of New Jersey and rules and regulations of the State Commissioner of Alcoholic Beverage Control.
Nothing herein contained shall be construed
to permit the issuance of a license to conduct a business for the
sale of alcoholic beverages on property in the Borough of Closter
contrary to the Zoning Ordinance in force in said Borough, together with amendments and
supplements thereto now or hereafter enacted.
If this article or any part thereof shall become
inconsistent with any amendment or supplement to "An Act Concerning
Alcoholic Beverages," known as Public Laws of 1933, Chapter 436, then such part shall be considered void and of no effect;
provided, however, that nothing in this article shall be affected
which is not inconsistent with such Act.
