[HISTORY: Adopted by the Township Committee of the Township of New Hanover 9-10-1991 by Ord. No. 1991-7. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
CLEANUP AND REMOVAL COSTS
All costs associated with a discharge within the boundaries of the Township of New Hanover, which shall include labor and material for the removal of hazardous substances or the taking of reasonable measures to prevent or mitigate damages to the public health, safety or welfare of the residents of the Township of New Hanover, including the lands, private and public, therein.
DISCHARGE
Any intentional or unintentional action or omission resulting in the release, spill, leak, emission, dump or disposal of hazardous substances into waters or lands within the Township of New Hanover or outside the Township when damage may result to waters or lands inside the Township.
DISPOSAL SITE
An appropriate and lawful location wherein hazardous substances can be properly and safely disposed.

HAZARDOUS SUBSTANCE
All elements and compounds, including petroleum products, as set forth in N.J.S.A. 58:10-23.11b, as amended, except that sewage and sewage sludge shall be considered hazardous substances for the purpose of this chapter.
HOUSEHOLD HAZARDOUS WASTE
Items commonly utilized by a resident at his home or domicile that contain hazardous substances and which are ordinarily excluded from household solid waste collection. Such items include, but are not limited to, oil-based paints, pesticides, thinners, household and automobile batteries, antifreeze, motor oil, gasoline, fluorescent lighting fixtures, and all such items containing hazardous substances.

PERSON
Any individual, public or private corporation, company, association, society, firm, partnership or joint-stock company.
Any person who shall discharge hazardous substances within the Township of New Hanover shall be strictly liable for all cleanup and removal costs incurred by the Township of New Hanover or agencies and employees thereon.
Upon assessment of cleanup and removal costs, the person assessed may, within 10 days of receipt of such assessment, make a written request for a hearing before the Township Committee exclusively upon the reasonableness of the amount assessed.
The person responsible for the discharge shall be liable for all reasonable attorneys' fees and costs incurred in the collection of cleanup and removal costs.

A. 
It shall be unlawful for any person to dispose of household hazardous waste at any location other than a properly designated disposal site;
B. 
It shall be unlawful for any person to dispose of household hazardous waste on any municipally owned property, except on such day when local disposal or dropoff is approved for a special dropoff or collection day by the Burlington County Office of Waste Management.

Any person who violates this chapter shall, upon conviction, be subject to a fine not exceeding $1,000, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days.
