The Township of Brecknock hereby elects to join the Pennsylvania Municipal Retirement System under Article IV of the Pennsylvania Municipal Retirement Law, Act No. 15 of 1974, as amended,[1] and does hereby agree to be bound by all the requirements and provisions of the said Pennsylvania Municipal Retirement Law and the amendments thereto and to assume all obligations, financial and otherwise, placed upon member municipalities by said article, law and amendments, as the case may be. All references hereafter shall be based on benefits negotiated between the Pennsylvania Municipal Retirement Board and the township under the provisions of Article IV.

Membership in the Pennsylvania Municipal Retirement System shall be mandatory for all nonuniformed permanent employees. Membership for elected officials and employees hired on a temporary or seasonal basis is prohibited, as is membership for individuals paid only on a fee basis.
As part of this article, the Board of Supervisors of Brecknock Township agrees to the outline of benefits set forth in the agreement between the Pennsylvania Municipal Retirement Board and the township to be dated as of January 1, 1987. The passage and enactment of this article by the Board of Supervisors of the Township of Brecknock is an official acceptance of said benefit structure and the accompanying financial obligations contained in the administration of said benefit package. Credit for service rendered to the township will commence with the effective date of this article.
Payment for the obligations as established in this article and the agreement between the Pennsylvania Municipal Retirement Board and the Board of Supervisors of the Township of Brecknock shall be made by the township in accordance with said Pennsylvania Municipal Retirement Law and Act No. 205 of 1984, the Municipal Pension Plan Funding Standard and Recovery Act.[1]

A duly certified copy of this article and the accompanying agreement shall be filed with the Pennsylvania Municipal Retirement Board of the Commonwealth of Pennsylvania. Membership for the nonuniformed employees of the Township of Brecknock in the Pennsylvania Municipal Retirement System shall be effective the first day of January 1987.

Brecknock Township hereby elects to enroll its police officers in the Pennsylvania Municipal Retirement System, as authorized by the Pennsylvania Municipal Retirement Law, Act 15 of 1974, as amended,[1] with the express purpose of having the Pennsylvania Municipal Retirement System administer the retirement plan established by the township for its police officers. The township does hereby agree to be bound by all the requirements and provisions of said law and to assume all obligations, financial and otherwise, placed upon member municipalities. All references hereafter shall be based on benefits negotiated between the Board and the municipality under the provisions of Article IV of the Pennsylvania Municipal Retirement Law.

Membership in the Pennsylvania Municipal Retirement System shall be mandatory for all full-time police officers of the township. Membership for elected officials and employees hired on a temporary or seasonal basis is prohibited, as is membership for individuals paid only on a fee basis.
Credit for prior service for original employees is granted for each year or partial year thereof that the member was employed by the township from original date of hire. Benefits provided to members in the agreement dated February 10, 1998, shall accrue based on all credited service granted and earned in accordance with this section.
Payment for any obligation established by the adoption of this article and the agreement between the system and Brecknock Township shall be made by the township in accordance with the Pennsylvania Municipal Retirement Law and Act 205 of 1984, the Municipal Pension Plan Funding Standard and Recovery Act.[1]

As part of this article, the township agrees that the system shall provide the benefits set forth in the agreement between the Board and Brecknock Township, dated February 10, 1998. The passage and adoption of this article by Brecknock Township is an official acceptance of said agreement and the financial obligations resulting from the administration of said benefit package. Brecknock Township hereby assumes all liability for any unfundedness created due to the acceptance of the benefit structure outlined in the above-referenced agreement.
Brecknock Township intends this article to be the complete authorization of the township's police pension plan.
A duly certified copy of this article and the referenced agreement shall be filed with the Pennsylvania Municipal Retirement System of the Commonwealth of Pennsylvania. Membership for the police pension plan of Brecknock Township in the Pennsylvania Municipal Retirement System shall be effective on the first day of January 1998.
