This chapter shall be known as the "Construction Site Safety Ordinance," which ordinance is adopted to regulate highway/street construction sites within the Town of Barrington.
A. 
In order to promote and protect the health, safety, comfort and welfare of the Town's inhabitants, effective immediately with the passage of this chapter, all duly licensed general contractors and subcontractors (hereinafter sometimes referred to as the "permittee") authorized and permitted by the Town of Barrington to perform construction and/or repair work, including but not limited to repaving and road openings (hereinafter sometimes referred to as "construction work") on any highway and/or street within the Town, shall first obtain and furnish to the Town a bond with surety or sureties in an amount or amounts satisfactory to the Town Treasurer and Director of Public Works, guaranteeing to the Town of Barrington full performance by the applicant/permittee. Such bond(s) shall be issued as follows:
(1) 
Any permittee which performs construction work within the Town of Barrington on a regular basis, i.e., at least four times during the course of a year, may furnish to the Town a blanket bond, which bond shall cover all construction work performed by said permittee for a period of one year from the issuance of the bond.
(2) 
Any permittee which does not perform construction work on a regular basis within the Town, i.e., less than four times during the course of a year, shall furnish to the Town a bond for each job performed.
B. 
No construction work shall commence by a permittee unless and until said bond is furnished to and approved by the Town of Barrington.
Prior to the commencement of any construction work, the permittee shall obtain a permit from the Town of Barrington in an amount as may be established by the Town Council from time to time as indicated in the list of fees attached as Ch. A225 in the Appendix to the Code of the Town of Barrington.
With respect to construction work to be performed by the permittee and the subsequent restoration of the road surface, the permittee shall comply with the specifications for patching roadways as issued by the Department of Public Works and as may be amended from time to time. The Director of Public Works has the sole discretion to determine whether repaving or repatching will be necessary for the proper restoration of the roadway. In all events, the permittee shall maintain the surface of the roadway and other areas where work has been performed for as long as the Director of the Department of Public Works deems necessary, but in no event shall this period of time be less than two years from the date of the completion of the work.
Prior to the commencement of any construction work, the permittee shall make available and present to the Director of Public Works, Police Chief and Fire Chief, emergency contact telephone numbers for the permittee and shall also supply to the Police Chief a statement of the work to be performed as well as the commencement date and completion date of said construction work.
Prior to the detouring of traffic on the street, highway or roadway on which construction work is to be performed, the permittee, together with a representative of the Town, shall make an inspection of such roadway, street and/or highway to view and determine the adequacy of any and all detour signals. In the event that the structural condition of the detour route is altered by use of such route by section traffic, then it will become the responsibility of the permittee to repair all structural damages to the satisfaction of the Town.
The permittee shall take appropriate measures to ensure that, during the performance of any construction work, traffic conditions are to remain as near normal as possible, and the permittee will take all measures necessary to ensure that a normal traffic pattern is maintained at all times, so as to minimize the inconvenience to the occupants of the adjoining properties as well as the general public.
It shall be the duty and obligation of the permittee to ensure that the security of the traveling public is safeguarded and its rights are not unreasonably curtailed.
The permittee, unless otherwise indicated in the permit and/or license or as may be authorized by the Director of Public Works and/or the Town's inspector, shall ensure that the traveled path shall not be obstructed. Those portions of the road or highway which are torn up or which are used for the storing of materials or which, for any other reason, are unsafe for public travel shall be adequately protected and marked at all times to avoid the possibility of accidents. All such areas shall be marked at night by flares, lanterns, lights, flasher beacons or other warning devices approved by the Director of Public Works or, in their absence, the Police Chief. In addition, when portions of the traveled roadway are made dangerous for the movement of vehicles or pedestrians, a sufficient number of police officers, flag persons and/or traffic persons shall be employed by the permittee to direct the traffic safely through these dangerous areas. However, in all instances, the permittee, if possible, shall plan such construction work in an attempt to avoid such dangerous conditions.
