No person, not being at the time under police
or military duty, shall discharge any rifle, gun, musket, pistol,
air gun, spring gun or other small arms or any contrivances armed
to discharge shot, bullets, darts or other missiles in the Town of
Barrington, subject, however, to the following exceptions:
A. This section shall not apply, provided that the person
who shall discharge any of the weapons hereinabove described shall
do so on land owned or occupied by them; provided, however, that the
person who shall discharge any of the above weapons on land owned
or occupied by them shall at all times be a minimum distance of 125
yards from any building or premises without the specific permission
of the owner or occupant and shall not shoot at, along or across any
public highway.

B. This section shall not apply, provided that the person
who shall discharge any of the weapons hereinabove described on land
now owned or occupied by them shall do so only with the written permission
of the owners or occupants of the land on which they may shoot; provided,
however, that such person shall at all times carry such written permission
on their person and shall show and exhibit such written permission
when requested to do so, and provided, further, that none of the above-described
weapons shall be discharged within a distance of 125 yards from any
occupied building or premises, without the specific permission of
the owner or occupant, and such person shall not shoot at, along or
across any public highway.
C. This section shall not apply with regard to any tidal waterway within the Town of Barrington; provided, however, that no person, upon any tidal waterway in the Town, shall discharge any of the above-described weapons within the minimum distances prescribed in Subsections
A and
B of this section.
No person shall discharge any rifle, gun, musket,
pistol, air gun, spring gun or other small arms or any contrivances
armed to discharge shot, bullets, arrows, darts or other missiles
in such fashion that the shot, bullets, arrows, darts or other missiles
shall in their flight carry over or into the land of another into
which they shall not have written permission of the owner or occupant
thereof to shoot. Such written permission shall be carried on the
person at all times and shall be shown and exhibited upon request.
At the request of any resident of the Town of
Barrington, the Town Council may, in its discretion and with the permission
of the owner or occupant of suitable land, designate a place where
target practice with firearms or any contrivance arranged to discharge
shot, bullets, arrows, darts or other missiles may be carried on under
the restrictions hereinabove set forth, together with other such circumstances,
conditions, regulations and restrictions as the Town Council shall
impose. Such designation by the Town Council and such permission of
the Town Council shall be for such a period of time as in the discretion
of the Town Council may be met and proper and shall be subject to
revocation with or without cause by the Town Council at any time.
This chapter shall be enforced by the Chief
of Police and the Police Department of the Town of Barrington.

No provision of this chapter shall be construed
as prohibiting the use of armed guards or of firearms by private persons
in the Town for the protection or defense of person or property in
accordance with Rhode Island law.

Any person violating the terms and provisions of any section of this chapter, including failure to carry written permission on the person as provided for by §§
107-1B and
107-2, shall be fined in the minimum sum of $100 and a maximum fine of $500 for each and every offense.
