No person or corporation to whom has been granted a franchise, by virtue of Chapter
91 of the General Laws of the Sate of Rhode Island 1909, by the Town of Barrington shall execute or do any new
construction which would require digging into any of the streets or
highways of said Town without first giving 30 days' notice in writing
to said Town of the place, nature, mode and time of doing the proposed
new construction, and having obtained from the Town a permit in writing
granted by the Town Council and issued by the Town Clerk of said Town
to do and execute said proposed new construction.
No person or corporation to whom has been granted a franchise, by virtue of Chapter
91 of the General Laws of the State of Rhode Island 1909, by the Town of Barrington shall make any repairs to their
or its property or services that will require the digging into any
street or highway of said Town without first giving notice in writing
to said Town of the place, nature and mode and time of making said
repairs and having obtained from the Town a permit in writing granted
by the Surveyor of Highways and issued by the Town Clerk of said Town.
Permits in writing, granted and issued as aforesaid,
shall set forth the place, nature, mode and time of doing the proposed
new construction and proposed repairs, and the work must be done in
conformity therewith.
The Surveyor of Highways is hereby authorized
to grant permits to every person or corporation doing repairs to their
property or service, including new construction, which requires digging
into any of the streets or highways of said Town of Barrington to
make repairs as aforesaid. The Town Clerk is hereby authorized and
directed to issue the same as aforesaid when properly notified and
directed to do so by the Town Council or the Surveyor of Highways.
Every person or corporation doing construction
work or making repairs to property or service which require digging
into any of the streets or highways of said Town of Barrington shall
execute the work in such manner as to do the least damage to said
streets and highways and shall immediately after the completion of
the work repair, reconstruct and put said streets and highways in
as good condition as they were before operations commenced.
Every person or corporation, or the officers,
agents or servants thereof, violating any of the provisions of this
article shall pay a fine not exceeding $20 to be recovered for the
use of the Town of Barrington and applied to the Highway Fund.
