The city has prepared and adopted an emergency action guide and has
appointed an Incident Commander to be in charge during an emergency. A declaration
of a state of emergency by the Governor, Pinellas County or the City Commission
shall activate the emergency action guide. During a state of emergency the
Incident Commander shall have the authority to do anything listed in Subsections
A thorough H of this section. Nothing in this section shall be construed to
limit the authority of the City Commission to declare or terminate a state
of emergency and take any action authorized by law when sitting in regular,
special or emergency session.
A.
Utilize all available resources of the city as reasonably
necessary to cope with the emergency, including emergency expenditures not
to exceed $50,000. During the state of emergency the city's purchasing requirements
are waived.
B.
Declare any area or areas of the city off limits.
C.
Make provision for availability and use of temporary
emergency housing and emergency warehousing of materials.
D.
Establish emergency operating centers and shelters in
addition to or in place of those identified in county and city emergency action
guides.
E.
Confiscate merchandise, equipment, vehicles or property
needed to alleviate the emergency. Reimbursement shall be within 60 days at
the customary charge for the items in the 90 days preceding the emergency.
F.
Call on the resources of the state, county, federal or
other political subdivisions as necessary to assist in the mitigation of the
emergency or to help maintain law and order, rescue and traffic control.
G.
Direct all city personnel, including department heads
and individual members of the City Commission.
H.
Exercise such other powers as may be necessary to protect
the health, safety and welfare of the city during a state of emergency.
Pinellas County has emergency restrictions which go into effect countywide upon the county declaring a state of emergency. The City of South Pasadena incorporates by reference and adopts the following sections of the Pinellas County Code: Sec. 34-38, Curfew; Sec. 34-39, Water Restriction; Sec. 34-40, Retail Prices Regulated; and Sec. 34-41, Restriction on Sale of Alcoholic Beverages, copies of which are attached hereto as Exhibit A.[1] Said sections of the Pinellas County Code shall be enforced in
South Pasadena as local ordinances during a state of emergency which is declared
by the Governor, Pinellas County or the City Commission.

Upon the issuance of a mandatory evacuation order by the Governor, Pinellas
County or the City Commission, all business owners and operators doing business
in South Pasadena shall, within three hours of the commencement of the evacuation,
close their business establishments within the city which are located within
the mandatory evacuation zone. The Incident Commander shall have the authority
to immediately close any business at any time when the nature of the emergency
makes it impractical to allow a three-hour grace period. Nothing herein shall
permit the sale of alcohol during a state of emergency. For purposes of this
section the term "close" shall mean the establishment is not offering anything
for sale, lease, trade or rent and no services are being provided to the public.
Businesses shall remain closed until the evacuation order is lifted.
Any person, firm or corporation who fails to comply with or violates the provisions of this chapter shall be punished according to law and, upon conviction, shall be punished in accordance with the provisions of § 1-16 of this Code. Each day of continued noncompliance or violation shall constitute a separate offense. Nothing herein contained shall prohibit the city from taking such other lawful action as may be necessary to prevent or remedy any refusal to comply with the provisions of this chapter.
