As used in this Article, the following terms shall have the meanings
indicated:
Any malodorous, foreign or offensive liquid.
Any boat, motorboat, sailboat, vessel, houseboat, barge, floating
structure, floating home or any contrivance of any nature whatsoever which
is waterborne, whether or not the same is capable of moving under its own
power or by sail; provided, however, that this definition shall not apply
to boats, etc., which are utilized, temporarily, for promotional purposes
as part of an event, show, boat show or the like permitted by the City Commission.
[1]Boca Ciega Bay and any canal, turning basin or lagoon that has been
formed by digging, dredging or other mechanical excavation.
It shall be unlawful for any person, persons, firm or corporation to
deposit, place or discard in the waters of Boca Ciega Bay or any waterway
any noxious filth, wastewater, garbage or refuse of any kind or to permit
any oil, oil product, oil compound or phosphate detergent to escape into or
onto the water or waterways of the city.
Every watercraft on which human beings reside in excess of 24 hours
in any seven-day period shall be required to have one of the following methods
of disposal of human excreta and wastewater:
A.
A connection or hookup to the city water and sewer system.
The marina, yacht basin, office, club or other marina facility or upland owner
of the dock to which the watercraft is tied or moored shall furnish the occupants
of the watercraft with city sewer and water hookups and garbage facilities
for the removal of all sewage, wastewater and garbage generated by the living
or residing on the watercraft.
B.
A self-contained holding tank for sewage and wastewater.
Whenever any sewage or wastewater is to be removed from any watercraft, it
must be done by means of a pump-out unit or facility furnished by the marina,
yacht basin, office club or other marina facility or upland owner of the dock
to which the watercraft is tied or moored, with ultimate disposal into the
city sewer system.
C.
A self-disposing system and the treatment of sewage and
human waste. The watercraft shall also be required to be equipped with a self-contained
holding tank for wastewater, the disposal of which shall be the responsibility
of the marina, yacht basin, office club or other marina facility or upland
owner of the dock to which the watercraft is tied or moored.
D.
A City Code Inspector shall have the right to inspect watercraft to determine whether or not they comply with this section. If the watercraft does not comply, or if the Inspector is denied access, the owner/occupant(s) shall be subject to the penalties outlined in § 193-14.
