No person shall hereafter place or cause to be placed any encroachment,
obstruction or encumbrance, including permanent and/or temporary basketball
poles and hoops, nor throw, spill or dump dirt, ashes or other material
in, over, or upon publicly ordained streets or public places (the
term "street" shall include the right-of-way for said street), in
the Town without first having obtained a permit therefor.
The permit shall be issued by the Town Clerk. All applications
shall be subject to the approval of the Town Engineer or, in his absence,
the Street Committee of the Board of Aldermen. Such application shall
show:
A. The name and address of the applicant.
B. The proposed encroachment, obstruction or encumbrance, its nature,
location and expected duration.
C. That it will not interfere with proper storm drainage.
D. That it will not unnecessarily endanger the passage of vehicles.
E. That it will not be contrary to the public health, safety and welfare.
The Mayor and Board of Aldermen may, by a majority vote, declare
any encroachment, obstruction or encumbrance in, over, or upon any
publicly ordained street or public place which interferes with proper
drainage, or endangers the passage of vehicles or in any other manner
is contrary to the public health, safety and welfare, a public nuisance,
and may order the same to be abated in such manner as it shall designate,
or may prevent and remove the same.
Whenever any such public nuisance shall be ordered to be abated,
notice thereof by registered mail shall be sent by the Town Clerk
to any person responsible for the creation or maintenance of the same,
and any person creating or maintaining any such encroachment, obstruction
or encumbrance, who shall, for 30 days after receipt of the notice,
fail or refuse to abate the nuisance, shall be subject to the penalties
provided herein.
Any person who shall violate any of the provisions of this article shall be liable to the penalty stated in Chapter
1, General Provisions, Article
III, General Penalty.
