The provisions of Chapter
1 of the Code of the Borough of Franklin Lakes in the County of Bergen concerning definitions and construction shall apply to all chapters adopted by the Board of Health.
As used in this Code, the following terms shall
have the meanings indicated:
BOARD
The Board of Health of the Borough of Franklin Lakes.
CATTLE
Includes the following animals and their respective young:
cows, horses, mules, asses, sheep, goats, swine and other hoofed animals.
CLEANING
The thorough removal of contaminating material or materials,
rubbish or garbage.
CODE
Part III, Board of Health Legislation, of this Code as herein
designated, unless some other code is expressly indicated.
DWELLING
Any building, or portion thereof, which is occupied or is
intended to be occupied as a residence or sleeping place of one or
more individuals, families or households.
GARBAGE
The accumulation of animal or vegetable matter, or both,
liquid or otherwise, that tends to decay.
HEALTH OFFICER
The duly licensed Health Officer appointed or designated
by the Board of Health to enforce this Code or supervise this work
on behalf of the Board.
KENNEL
Any establishment or premises wherein or whereon the business
of keeping, raising, breeding or boarding dogs or other animals is
carried on, except that this definition shall not include a pet shop.
PERMIT or LICENSE
A duly authorized permit or license of the Board, issued
in accordance with this Code or the regulations of the Board.
PERSON
Any person, association, partnership, trust, or corporation,
or any one or more of them, or combination of any of them.
PET SHOP
Any room or group of rooms, cage or exhibition pen, not a
part of a kennel, wherein dogs for sale are kept or displayed.
POULTRY
Includes chickens, ducks, geese, turkeys, guinea fowl, pigeons,
pheasants, and all other fowl or winged animals kept, raised or sold
for human consumption or for production of eggs.
POUND
Any establishment designated for the confinement of dogs
seized under the provisions of this Code.
PROPERTY and PREMISES
Unless restricted or limited by the context to either real
or personal property, includes both.
PUBLIC PLACE
Includes any public place, as well as any restaurant, and
every other establishment or place where food or beverage is sold
or offered for sale to the public for consumption on the premises,
and any camp, tourist home or public recreation place or any other
place of business where toilet facilities or water for drinking or
culinary purposes is available for the use of the public.
QUARANTINE
The restriction of movement of any person who has been exposed
to a communicable disease by confining such person to a restricted
area, and the exclusion of other persons from that area.
REGISTRAR
The person duly appointed as Registrar of Vital Statistics
by the Board of Health.
REGISTERED ENVIRONMENTAL HEALTH SPECIALIST
An individual who is licensed pursuant to N.J.A.C. 8:7 and
is responsible for the performance of inspections, the compilation
of proper records of inspections, the collection of evidence of violations,
and the issuance of notices of violation to responsible parties.

REGULATIONS
Includes any regulations, whether general or special, which
the Board may from time to time lawfully adopt and issue.
RETAIL FOOD ESTABLISHMENT
An operation that stores, prepares, packages, serves, vends,
or otherwise provides food for human consumption.

RUBBISH
Includes all coal or wood ashes, all loose material and dirt-like
substance and all waste material accumulated from buildings or the
cleaning of buildings.
SANITATION
The application of cumulative heat or chemicals on cleaned
food contact surfaces that, when evaluated for efficiency, is sufficient
to yield a reduction of five logs, which is equal to a 99.999% reduction,
of representative disease microorganisms of public health importance.

SMALL ANIMALS
Includes rabbits, guinea pigs, rodents and any other small
animal kept or raised for commercial purposes or kept and raised for
sale or for the production of meat, fur or wool or kept and raised
for exhibition or as a source of supply for laboratories; provided,
however, that the term "small animals" shall not apply if they total
in the aggregate fewer than six in number.
STREET
Includes every public street, avenue, sidewalk, gutter, highway,
park or public place in the Borough.
TENANT
Any person occupying any house, building or portion thereof
which is rented, leased, let or hired out to be occupied as a house,
residence or a business establishment.
In the construction of this Code, or any amendments
hereof or any supplements hereto, words and phrases shall be read
and construed in accordance with their context and, unless inconsistent
with the manifest intent of the Board, as expressed herein.
A. Unless another or different meaning is expressly indicated,
such words or phrases shall be given the meaning expressed herein,
or, if no such meaning is given, the generally accepted meaning according
to the approved usage of the language shall be applied.
B. Technical, trade or commercial words and phrases,
and words and phrases having a special or accepted meaning in the
law, shall be construed in accordance with such technical, trade,
commercial or special and accepted meaning.
C. Unless otherwise indicated by the context, the definitions
herein contained shall apply to the terms used in other definitions.
D. Unless otherwise indicated by the context, the singular
shall include the plural, and one gender shall include the other genders.
