For the purposes of this chapter, the following terms shall have the
meanings indicated:
SKATEBOARD
A single platform which is mounted on wheels that is propelled by
the rider and steered by tilting the board in the desired direction.
Every person operating a skateboard upon a roadway shall be granted
all of the rights and shall be subject to all of the duties applicable to
the driver of a vehicle by Chapter 4 of Title 39 of the Revised State Statutes
with the additional regulations:
A. Persons operating a skateboard upon a roadway may travel
no more than two abreast when the traffic is not impeded, but otherwise shall
ride in single file, except on paths or parts of roadways set aside for the
exclusive use of skateboards, roller skates or bicycles.
B. Any person operating a skateboard who is under the age
of 14 must wear a helmet that meets state bicycle helmet specifications.
No person shall place any apparatus or equipment, such as ramps used
by skateboarders, on any public street, public sidewalk, public park, public
parking lot or other public place within the Township of Montclair. (This
regulation can be waived on playgrounds and parks operated by the Board of
Education or the Department of Parks and Recreation if either of these bodies
approves of such use, on a temporary or permanent basis, in writing.
Any person who violates any of the provisions of §
285-2 shall, upon conviction thereof, be punished by a fine not exceeding $100.
