Mobile homes shall not be placed on a lot within the village limits of the Village of Albion, except in an approved mobile home park. Existing, nonconforming mobile homes may continue, but shall not be replaced by another mobile home.
It shall be unlawful for any person to locate, construct, alter or extend any mobile home park within the limits of the Village of Albion unless he or she holds a valid operating permit issued by the Board of Trustees of the Village of Albion. Operating permits are issued and valid only for a twelve-month period, but may be renewed as provided for herein.
A. 
All applications for permits or for renewal of permits shall be submitted to the Village of Albion Bureau of Code Enforcement and Fire Prevention.
B. 
All original applications for permits shall contain the following:
(1) 
The name and address of the applicant; if the applicant is a partnership, the names and addresses of the partners; if the applicant is a corporation, the names and addresses of the officers and directors.
(2) 
The name and address of the owner of the land.
(3) 
The location and legal description of the mobile home park.
(4) 
Two sets of engineering and/or architectural plans and specifications of the proposed park showing:
(a) 
The area and dimensions of the tract of land.
(b) 
The number, location and size of all mobile home lots.
(c) 
The location and width of roadways and parkways.
(d) 
The location of service buildings and any other proposed structures.
(e) 
The location of water and sewer lines and riser pipes.
(f) 
Plans and specifications of the water supply and refuse and sewage disposal facilities.
(g) 
Plans and specification of all buildings to be constructed, altered or extended within the mobile home park.
(h) 
The location and details of lighting and electrical systems.
C. 
All applications for permits or renewals of permits shall be accompanied by the deposit of a fee as set forth from time to time by resolution of the Board of Trustees.[1]

D. 
Upon review of the application and subject to evidence that the mobile home park meets the minimum requirements of the New York State Department of Health, the Village Board shall issue or renew a permit when a review of the application and inspection of the site demonstrates that the proposed or existing mobile home park meets the requirements of this chapter.
E. 
All applications for original permits shall be reviewed by the Planning Board of the Village of Albion for approval before being submitted to the Village Board of Trustees pursuant to § 179-7D of this chapter.
A. 
The Fire Marshal is hereby authorized and directed to make such inspections as are necessary to determine satisfactory compliance with this chapter.
B. 
The Fire Marshal shall have the power to enter at reasonable times upon any private or public property for the purpose of inspecting and investigating conditions relating to enforcement of this chapter.
C. 
The Fire Marshal shall have the power to inspect the register containing a record of all residents of the mobile home park.
Any operating permit for a mobile home park may be revoked when it is found to be in violation of this chapter.
A. 
Should the Fire Marshal find that conditions exist which are in violation of any provision of this chapter, he or she shall give notice, in writing, to the permittee that, unless such conditions or practices are corrected within 10 days, the permit will be revoked.
B. 
If, at the end of 10 days, a further inspection reveals that the conditions or practices have not been corrected, the Fire Marshal shall then revoke the permit and give notice of such suspension, in writing, to the permittee. Upon notice of revocation, the permittee shall cease operation of the mobile home park.
Mobile home parks operating under a valid operating permit issued prior to the effective date of this chapter may continue to operate under the terms of such permit until it expires. Before a renewal permit may be issued, such parks shall be brought into compliance with the provisions of this chapter, except where existing conditions are permitted to continue, as specified by this chapter.
A. 
Petition. Any person affected by any notice which has been issued in connection with the enforcement of any provision of this chapter or of any regulation adopted pursuant thereto may request and shall be granted a hearing on the matter before the Board of Trustees of the Village of Albion, provided that such person shall file in the office of the Village Clerk a written petition requesting such hearing and setting forth a brief statement of the grounds therefor within 10 days after the notice was served. The filing of the request for a hearing shall operate as a stay of the notice and the suspension, except in the case of an order issued under § 179-12. Upon receipt of such petition, the governing body shall set a time and place for such hearing and shall give the petitioner written notice thereof.
B. 
Hearing. At such hearing the petitioner shall be given an opportunity to be heard and to show why such notice should be modified or withdrawn. The hearing shall be commenced not later than 10 days after the day on which the petition was filed, provided that, upon application of the petitioner, the governing body may postpone the date of the hearing for a reasonable time beyond such ten-day period when, in the judgment of the governing body, the petitioner has submitted good and sufficient reasons for such postponement.
C. 
Order of the governing body. After such hearing, the governing body shall make findings as to compliance with the provisions of this chapter and regulations issued thereunder and shall issue an order sustaining, modifying or withdrawing the notice, which shall be served in writing. Upon failure to comply with any order sustaining or modifying a notice, the license of the mobile home park affected by the order shall be revoked.
Whenever the Fire Marshal finds that an emergency exists which requires immediate action to protect the public health, he or she may, without notice or hearing, issue an order reciting the existence of such an emergency and requiring that such action be taken as he or she may deem necessary to meet the emergency including the suspension of the permit or license. Notwithstanding any other provisions of this chapter, such order shall be effective immediately. Any person to whom such an order is directed shall comply therewith immediately, but, upon petition to the governing body, he or she shall be afforded a hearing as soon as possible. The provisions of § 179-11 shall be applicable to such hearing and the order issued thereafter.
