No person shall, and it shall be unlawful for any person to erect, raise,
establish or maintain any tent, trailer or other place of temporary habitation,
to be used or occupied as a place for living or sleeping on any public or
private property within the corporate limits of the Village of Atlantic Beach.
No person shall, and it shall be unlawful for any person to use or occupy
as a place for living or sleeping within the corporate limits of the Village
of Atlantic Beach any tent, trailer or other place of temporary habitation,
or any building or structure for which a certificate of occupancy has not
been issued by the Village of Atlantic Beach or other municipal authority
having jurisdiction thereof.

Any person or corporation who shall violate any of the provisions of
this chapter, or fail to comply therewith, or with any of the requirements
thereof, or who shall build or alter or use any building or land in violation
of any detailed statement or plan submitted and approved hereunder, shall
be guilty of a misdemeanor, punishable by a fine not exceeding $500 or imprisonment
for a period not to exceed 15 days, or both. Each day's continued violation
shall constitute a separate additional violation. The owner or owners or lessee
of any building or premises, or part thereof, where anything in violation
of this chapter shall be placed, or shall exist, and any architect, builder,
contractor, agent, person or corporation employed in connection therewith,
and who have assisted in the commission of any such violation, shall each
be guilty of a separate offense and upon conviction thereof, shall be fined
as herein provided.

The erection of any temporary structure for commercial use is forbidden
until a permit, specifying the purpose and the time limit for such use, shall
have been obtained from the Village Clerk or the Building Inspector after
the approval by resolution of the Board of Trustees, except that the Village
Clerk may waive the requirement for the approval of the Board of Trustees
for good cause shown. The term "temporary structure" shall be taken to mean
platforms, reviewing stands, tents and other structures erected to serve temporary
purposes.
Every temporary structure shall be removed immediately upon the expiration
of the period for which the permit was issued.
Any tent or similar type structure for which a permit has been issued
must comply with all of the provisions of Section 3103 of the Building Code
of New York State and Chapter 24 of the Fire Code of New York State.
In commercial establishments, access to the area covered by the tent
or other similar type structures must be by way of the main entrance.
The Board of Trustees may revoke a permit if the provisions of this
article or a violation of any law affecting health or safety occurs while
the permit is in effect.
