Where a public sanitary sewer is not available under the provisions of Article
III, §
177-7, the building sewer shall be connected to a private sewage disposal system complying with the requirements of the Albany County Health Department.
Before the issuance of a building permit for the construction of a private
sewage disposal system, the owner shall first obtain a written permit, duly
approved by the Albany County Health Department, for the proposed facilities.
Two copies of the plans approved by the Albany County Health Department shall
be filed with the Code Enforcement Officer of the Village of Colonie. Upon
receipt of the county permit, the Superintendent of Public Works will issue
a village permit for a nonrefundable fee, in an amount to be determined by
the Board of Trustees from time to time, to cover the cost of inspection.
Permission for use of a private sewage disposal system shall not become
effective until the installation is completed to the satisfaction of the Albany
County Health Department and the Superintendent of Public Works. Representatives
of the Albany County Health Department and the Superintendent of Public Works
shall be allowed to inspect the work at any stage of construction, and the
applicant for the permit shall notify the Albany County Health Department
and the Superintendent of Public Works when the work is ready for final inspection
and before any underground portions are covered. The inspection shall be made
within 72 hours of the receipt of notice.
The type, capacities, location and layout of a private sewage disposal
system shall comply with all recommendations of the Albany County Health Department.
No permit shall be issued for any private sewage disposal system employing
subsurface soil absorption facilities where the area of the lot is less than
twenty thousand (20,000.) square feet. No septic tank or cesspool shall be
permitted to discharge to any natural outlet or storm sewer.
At such time as a public sanitary sewer becomes available to a property served by a private sewage disposal system, as provided in §
177-7A of this chapter, a direct connection shall be made to the public sewer in compliance with this chapter, and any septic tanks, cesspools and similar private sewage disposal facilities shall be abandoned, cleaned of sludge and filled with suitable materials, as approved by the Superintendent of Public Works.
The owner shall operate and maintain the private sewage disposal facilities
in a sanitary manner at all times at no expense to the village. Overflow of
any effluent onto the ground or into any watercourse or storm drain is prohibited.
Immediately upon discovery of such unhealthy condition or any other health
hazard or nuisance, the use of such septic tank or outlet must be discontinued
or the installation repaired to remedy such condition, hazard or nuisance.
Upon written notice by the Superintendent of Public Works, it is the duty
of the owner to remedy the situation within 10 days.
No statement contained in this Article shall be construed to interfere
with any additional requirements that may be imposed by the Albany County
Department of Health.
