No swimming pool, as defined in this chapter, shall be constructed, installed, enlarged or altered unless a building permit is issued therefor. The applicant shall provide the Code Enforcement Officer with a plot plan showing the location of the pool and the plans and specifications in detail. The charge for such permit shall be as set by resolution of the Board of Trustees, from time to time.
As used in this chapter, the following terms shall have the meanings indicated:
SWIMMING POOL
A body of water in an artificial receptacle or other container having a depth of water at any point greater than 24 inches or having a water surface area greater than 150 square feet, whether located indoors or outdoors or above ground or below ground, which is used or intended to be used for swimming or bathing, including all structures, appurtenances, equipment, appliances or other facilities pertinent to and maintained for the operation thereof.

Any auxiliary structures associated with a pool shall comply with the New York State Uniform Fire Prevention and Building Code.
All swimming pools and all alterations to swimming pools shall be constructed to ensure against collapse thereof and leakage of water therefrom. Sand, dirt or wooden bottoms are prohibited. Pools shall be so constructed that the area adjacent thereto shall pitch away from the pool and the top of the pool coping shall be at least one inch above the surface of the area surrounding the pool deck.
There shall be no cross-connections between the piping system of a swimming pool and a potable water system. If water is supplied from a potable water system, the inlet or fill pipe shall be located at least six inches above the overflow level of the coping of such pool.
Pools shall be equipped with filters which shall be capable of maintaining the clarity of the water.
All swimming pools shall be provided with an adequate drainage outlet. For regulation of discharge, see Chapter 177, Sewers. Discharges into sanitary sewers are prohibited.

The wiring of all fixtures and appliances shall conform to the National Electric Code, current edition, and any applicable county, town and Village codes. All electrical apparatus shall be properly grounded, and a certificate of inspection and approval of the New York Board of Fire Underwriters or other authorized inspection agency shall be furnished to the Code Enforcement Officer in connection therewith.
A. 
Outdoor swimming pools, as defined under the Uniform Code, shall be completely enclosed by a wall or fence not less than four feet in height. All gates or doors opening through such enclosure shall be equipped with a self-closing and self-latching device for keeping the gate or door securely closed at all times when not in actual use.
B. 
The purpose of this section is to exclude unauthorized and uninvited individuals from the area of the swimming pool, and the Code Enforcement Officer shall, in each individual application, decide upon the adequacy of the proposed enclosure.
In-ground swimming pools which shall be abandoned or permanently discontinued shall be permanently filled, regraded and landscaped. Aboveground swimming pools which shall be abandoned or permanently discontinued shall be removed.
Where lights are used to illuminate any portions of a swimming pool, they shall be so arranged or shaded as to reflect light away from any adjoining premises or public highways.
A swimming pool may be filled by water furnished by the Village either:
A. 
From a tap on the house side of a water meter; or
B. 
From a hydrant, provided that a permit has been obtained from the Superintendent of Public Works (see § 234-21B).
Any person violating any provision of this chapter shall be subject to a fine not exceeding $250 and/or to imprisonment for not more than 15 days, and each day of continuance of any such violation after notice thereof by the Code Enforcement Officer shall constitute a separate offense.
