Unless an extension of time shall have been granted by the Building
Inspector, work under any permit to open a street or sidewalk shall be commenced
within 30 days from the date of the issuance of the permit and continued in
an expeditious manner.
If any street opening remains unfilled or is not covered with temporary
or permanent resurfacing as herein provided for a period of 24 hours after
personal notice, or 48 hours after the mailing (by certified mail, return
receipt requested) of a notice directing same by or on behalf of the Board
of Trustees to the permit holder at the address set forth on the application,
such work as shall be necessary to remove or correct the condition shall be
performed on behalf of the Board of Trustees, and the entire cost thereof,
including any attorneys' fees incurred, shall be assessed by the Board of
Trustees against the permit holder.
Permit holders shall notify the Building Inspector when work has been completed, after which an inspection will be made by the Building Inspector or his duly authorized agent, and upon approval of the work a release will be granted to the permit holder. Until the granting of such release, the permit holder shall remain liable for proper guarding and protection as provided in §
A154-2.
All permanent resurfacing of street openings shall be guaranteed for
a period of five years by bond or security acceptable to the Board of Trustees.
The Village reserves the right to replace any or all cuts or to alter any
replacements which may have been performed by or for the permit holder and
to charge the cost of same against the aforesaid security.
