This chapter shall be known and cited as the "Licensed Entertainment Ordinance of the Village of Wappingers Falls, New York."
A. 
No person, firm or corporation shall conduct, maintain, operate or use any building, plot or parcel of land for the operation, maintenance or conducting of a carnival, circus, theatrical production, concert, lecture or exhibition of any kind intended to be patronized by the public, and for which an admission fee may or may not be charged, without having obtained a license therefor from the Village Clerk.
B. 
No nude bars will be allowed within the village limits, regardless of alcoholic beverages being served or not.

Nothing in the foregoing shall apply to bazaars, fairs or any entertainment as approved, in writing, by the Village Board and held in the Village of Wappingers Falls if the Village Board, after inquiry, determines that the primary purpose of the event is for the profit of local religious, fraternal, educational, political, veterans, firemen’s, civic, nonprofit or charitable organizations.
A. 
No license or approval shall be issued if the Village Board decides that the function will disturb the public peace and good order or adversely affect the use and enjoyment of the adjoining properties or that conduct of the function will not be consistent with public health, safety or welfare.
B. 
The Village Board may impose reasonable restrictions, conditions and safeguards upon the issuance of the license or approval of the function so as to assure consistency with the standards set forth above, including a requirement for the deposit of an adequate sum of money with the village at the time of issuance of the permit or approval to guarantee restoration of the premises to a neat and orderly condition upon completion of the function.
C. 
All permits shall contain a provision to the effect that no part of the authorized function will be in operation between the hours of 1:00 a.m. and 8:00 a.m. of the following day, time then in effect. No loud or unreasonable noise, explosions, music, etc., which may be part of the authorized function is allowed between the hours of 10:00 p.m. and 9:00 a.m. of the following day or such other times as indicated in the permit or written approval.

The license fees shall be as follows:
A. 
For carnivals (amusement show having rides, sideshows, games and refreshments) and any festivals as a program of entertainment or sports as well as motor-driven vehicle programs, the fee will be as set by resolution of the Board of Trustees.[1]

B. 
For theatrical productions for companies or organizations not located in the village, lectures (prepared talks on specific or varied subjects delivered before an audience by other than a village resident group or organization) or any exhibitions not deemed acceptable to the general public morals, the fee will be as set by resolution of the Board of Trustees.[2]

C. 
For concerts, public performance of a vocal or musical instrumental group or individual, the fee will be as set by resolution of the Board of Trustees.[3]

Any license issued hereunder by the Village Clerk may be revoked:
A. 
In the event of violation of any regulation connected with the issuance of the license or of any law of the State of New York or of any of the provisions of this chapter or any other ordinance of the Village of Wappingers Falls.
B. 
If, in the judgment of the appropriate Village, county or state department having jurisdiction, respectively, the health, safety, welfare or morals of the Village of Wappingers Falls will be adversely affected by the continuance of the licensed premises.

Any person violating any provision of this chapter may be punishable by a fine of not more than $250 or imprisonment for a period not exceeding 15 days, or both.
