As used in this chapter, except where the context
clearly indicates otherwise, the following words and/or phrases have
the meaning indicated below:
ABUT
Next to or adjacent to and includes the words "directly across
from streets, natural features and rights-of-way."
ACCESSORY BUILDING
A building (such as a private garage, private swimming pool
and appurtenant bathhouse, private toolhouse, children's playhouse
or a noncommercial greenhouse) which is subordinate and accessory
to a principal building on the same lot and which is used for purposes
customarily incidental to those of the principal building.
ACCESSORY STRUCTURE
A structure serving a purpose customarily incidental to the
use of the principal building and located on the same lot as the principal
building.
ALLEY
An "alley" is a minor way, which may or may not be legally
dedicated, and is used primarily for vehicular service access to the
rear or side of properties otherwise abutting on a street.
ALTERATIONS
Alterations include, but are not limited to the following:
A.
All incidental changes or replacement in the
nonstructural parts of a building or other structure.
B.
Minor changes or replacements in the structural
parts of a building or other structure, such as the following examples:
(1)
Change of interior partitions to improve livability
in nonconforming residential buildings, provided that no additional
dwelling units are created thereby;
(2)
Change of interior partitions in all other types
of buildings or other structures;
(3)
Making windows or doors in exterior walls; or
(4)
As applied to a building or structure, a change
or rearrangement in the load-bearing and non-load-bearing structural
members, resulting in the extension of any side or the increase in
height.
C.
The moving of the building or structure from
one location or position to another or the conversion of one use to
another by virtue of interior change.
APARTMENT
See definition of "dwelling unit."

APPLICANT
The person(s), company, partnership, profit or nonprofit corporation or trust responsible for a particular application for an approval or permit under Chapter
240, Zoning, and his/her heirs, successors and assigns (see §
205-6).
APPLICATION FOR DEVELOPMENT
Every application, whether preliminary or final, required
to be filed and approved prior to start of construction or development,
including but not limited to an application for a building permit,
for the approval of a subdivision plat or plan or for the approval
of a development plan.
BLOCK
Property bounded on one side by a street and on the other
three sides by a street, railroad right-of-way, public park, waterway,
Township line or any combination thereof.
BOARD OF SUPERVISORS
The Board of Supervisors of East Goshen Township or any Board
of Commissioners that may succeed the Board of Supervisors.
BUFFER YARD
A strip of land which may be a part of the minimum setback
distance and which is free of any principal or accessory building,
parking, outdoor storage or any use other than open space, and which
includes plant screening.
BUILDING
Any structure having a roof supported by columns or walls,
used for the shelter, housing or enclosure of persons, animals or
property. "Building" is interpreted as including the words "or part
thereof."
BUILDING SETBACK LINE
The line defining the minimum required distance between a
right-of-way line and the location of any structure.
CALIPER
For trees which are a minimum of 12 feet in height, the diameter
of a tree trunk measured at a point 4 1/2 feet from the ground surface.
For trees that are less than 12 feet in height, the diameter of a
tree trunk measured at a point one foot from the ground surface.

CARTWAY (ROADWAY)
The portion of a street right-of-way, paved or unpaved, customarily
used by vehicles in the regular course of travel over the street.
CELLAR
See definition of "story."
CLEAR SIGHT TRIANGLE
An area of unobstructed vision at street intersections defined
by lines of sight between points at a given distance from the intersection
of the street right-of-way, cartways or center lines.
COMMON AREA
That portion of development tract owned in undivided fee
interest by the unit owners in such condominium and set aside for
their exclusive use and enjoyment.
COMMON OPEN SPACE
Land or an area of water or a combination of land and water
legally preserved for a minimum ninety-nine-year period or perpetuity
and intended for the use and enjoyment of the residents of a development
and/or the general public and which consists of landscaped or natural
terrain (including lakes and streams).
A.
Common open space shall be free of buildings,
except for recreational and utility buildings specifically approved
by the Board of Supervisors as part of the initial development plan.
B.
Common open space shall not include street rights-of-way,
private streets, any yard or other area required to meet a requirement
for an individual building lot or off-street parking areas except
for parking areas clearly needed to serve the permitted uses on the
common open spaces.
C.
Common open space may include recreational uses
such as tennis courts, squash courts, playgrounds, golf courses, swimming
pools or other similar uses that do not primarily involve buildings.
COMPREHENSIVE PLAN
The document adopted as the Comprehensive Plan for the Township
of East Goshen by the Board of Supervisors.
CONDOMINIUM
Real estate, portions of which are designated for separate
ownership and the remainder of which is designated for common ownership
solely by the owners of those portions created under either the Pennsylvania
Unit Property Act of July 3, 1963, or the Pennsylvania Uniform Condominium
Act.
CROSSWALK (INTERIOR WALK)
A publicly or privately owned right-of-way for pedestrian
use extending from a street into a block or across a block to another
street.
DATUM
A real or assumed level or plane used as a basis for calculations
or measurements from which elevations and depths are measured in surveying.
DENSITY
The total number of units per acre as computed and stipulated in Chapter
240, Zoning (as amended).
DESIGN STANDARDS
Minimum standards for the layout by which a subdivision or
land development is created.
DETACHED
Used to describe a structure which has yards on all sides.
DETENTION BASIN
A reservoir, formed from soil or other material, which is
designed to temporarily detain a certain amount of stormwater from
a drainage area in order to reduce the velocity and volume of peak
flows.
DEVELOPER
Any landowner, agent of such landowner or tenant with the
permission of such landowner, who makes or causes to be made a subdivision
of land or a land development.
DEVELOPMENT
Any man-made change to improved or unimproved real estate,
including but not limited to buildings or other structures, mining,
dredging, filling, grading, paving, excavation or drilling operations.
DISTRIBUTION
The processing of materials so as to sort out which finished
goods are to be transported to different locations, and the loading
and unloading of such goods. This use usually involves inventory control,
material handling, order administration and packaging.
DRAINAGE
The flow of water or liquid waste and the method of directing
such flow, whether natural or artificial.
DRIPLINE
The line marking where the outer edges of a tree’s
branches overhang the ground.

DRIVEWAY
A privately owned, constructed and maintained vehicular access
from a street or access drive to only one or two dwelling units or
commercial, institutional or industrial principal uses.
DWELLING UNIT (HOUSING UNIT)
A single habitable living unit occupied by only one family. See definition of "family." Each dwelling unit shall have its own toilet, bath or shower, sink, sleeping area, stove, oven and refrigerator, and have separate access to the outside or to a common hallway or balcony that connects to outside access at ground level. No dwelling unit shall include a separate living area that is completely separated by interior walls so as to prevent interior access from the remainder of the living area, or shall include a second kitchen, unless specifically permitted by Chapter
240, Zoning.
A.
SINGLE-FAMILY DETACHED DWELLINGA dwelling unit which has yards on all sides. The term "single-family detached dwelling" shall be deemed to include a sectional or modular home which is designed for transportation after fabrication in one or more units and constructed so that it must be assembled on a permanent perimeter foundation and which complies with Chapter
100, Building Construction.
(1)
MOBILE (MANUFACTURED) HOME:
(a)
A type of single-family detached dwelling intended
for permanent occupancy and contained in one unit designed to be joined
into one integral unit, which is transportable and capable of again
being separated for repeated towing, which arrives at a site complete
and ready for occupancy, except for minor and incidental unpacking
and assembly operations and is constructed so as to be used without
a conventional perimeter foundation. The terms "mobile home" and "manufactured
home" have the same meaning.
(b)
As opposed to a sectional home, a mobile/manufactured home does not rest on a permanent perimeter foundation and under federal law is not required to meet Chapter
100, Building Construction.
B.
SEMIDETACHED DWELLINGA dwelling unit, surrounded on all but one side by yards, located so that one wall is on or adjoining a side lot line and abuts the neighboring house.
C.
TOWNHOUSE DWELLINGA single-family attached dwelling unit with one dwelling unit from ground to roof, two points of independent outside access, at least two other dwellings built in conjunction herewith and any portion of one or two unpierced vertical fire-resistant party walls common with an adjoining dwelling and having yards on at least two sides. Townhouses may be attached back-to-back or side-by-side.
D.
APARTMENT DWELLINGA building or group of buildings with common ownership on a lot with three or more dwelling units used specifically for residential purposes and originally constructed as such.
EASEMENT
A right-of-way granted, but not necessarily dedicated, for
a private, public or quasi-public purpose.
EMPLOYEES
The highest number of workers (including both part-time and
full-time, both compensated and volunteer and both employees and independent
contractors) present on a lot at any one time, other than clearly
temporary and occasional persons working on physical improvements
to the site.
ENGINEER
A licensed professional engineer registered by the Commonwealth
of Pennsylvania in accordance with the Act of May 23, 1945 (P.L. 913,
No. 367), known as the "Engineer, Land Surveyor and Geologist Registration
Law," except that this requirement shall not preclude the preparation
of a plat in accordance with the Act of January 24, 1966 (1965 P.L.
1527, No. 535), known as the "Landscape Architects Registration Law,"
when it is appropriate to prepare the plat using professional services
as set forth in the definition of the "practice of landscape architecture"
under Section 2 of that Act.
ENGINEER, TOWNSHIP
A licensed professional engineer registered by the Commonwealth
of Pennsylvania and appointed on a yearly basis to act as consulting
engineer for the Township.
EROSION
The movement of soil by the action of wind and/or water.
FAMILY
A "family" is a single person occupying a dwelling unit and
maintaining a household; two or more persons related by blood, marriage,
formal foster relationship or adoption occupying a dwelling unit,
living together and maintaining a common household, including not
more than one boarder, roomer or lodger; or not more than three unrelated
persons occupying a dwelling unit, living together and maintaining
a common household.
FENCE
A man-made barrier placed or arranged as a line of demarcation,
enclosure or visual barrier that is constructed of wood, chain link
metal, vinyl, aluminum and/or plastic inserts. Man-made barriers constructed
principally of masonry, concrete, cinder block or similar materials
shall be considered a wall. The term "wall" does not regulate engineering
retaining walls, which are permitted uses as needed in all districts.
FLOOD
A general and temporary inundation of normally dry land areas.
FLOODPLAIN
A relatively flat or low land area adjoining a river, stream
or watercourse which is expected to be subject to partial or complete
inundation once in every 100 years.
FLOODWAY
The designated area of a floodplain required to carry the
discharge waters of a one-hundred-year flood.
GARAGE
An accessory building, either attached to or separate from
the principal building, which is used only for storage purposes.
GOLF COURSE
Either a publicly or privately owned and operated course which shall have a minimum of nine holes of golf. Neither a commercial driving range nor a commercial miniature golf area shall be considered a golf course for the purposes of Chapter
240, Zoning.
GRADE
The elevation of finished ground or paving which adjoins
a building.
GREENWAY
A loosely defined term for any open space which can be used
for the establishment of a wildlife or recreation corridor.

HAZARDOUS LIQUID PIPELINE
Any pipeline designed for transmission of a hazardous liquid
as regulated by 49 CFR 195.2.

HISTORICAL COMMISSION
An advisory board designated by the Board of Supervisors
to deal with matters pertaining to any of the Township's identified
historic resources. The authority for and powers of this commission
are drawn primarily from the Pennsylvania Municipalities Planning
Code.
IMPROVEMENT SPECIFICATIONS
Minimum standards for the construction of the required improvements
such as streets, curbs, sidewalks, water mains, sewers, drainage facilities,
public utilities and other items required to render the land suitable
for the use proposed.
INVASIVE TREES
Trees designated by the Pennsylvania Department of Conservation
and Natural Resources as being invasive trees.

LAND DEVELOPMENT
A.
The improvement of one lot or two or more contiguous
lots, tracts or parcels of land for any purpose involving:
(1)
A group of two or more residential or nonresidential
buildings, whether proposed initially or cumulatively, or a single
nonresidential building on a lot or lots regardless of the number
of occupants or tenure; or
(2)
The division or allocation of land or space,
whether initially or cumulatively, between or among two or more existing
or prospective occupants by means of or for the purpose of streets,
common areas, leaseholds, condominiums, building groups or other features.
LANDOWNER
The owner of a legal or equitable interest in land, including
the holder of an option or contract to purchase (whether or not such
option or contract is subject to any condition) or a lessee if he
is authorized under the lease to exercise the right of the landowner.
See "applicant."
LOT
A separate parcel of land held in single and separate ownership
that is recorded as a lot, or will be recorded after Township final
subdivision approval, in the office of the County Recorder of Deeds.
A.
CORNER LOTA lot bounded on at least two sides by streets, whenever the lines of such streets, extended, form an interior angle of 135º or less. A corner lot has a designated front lot line and a designated side street lot line.
C.
FLAG LOT or FLAG-SHAPED LOTAn irregularly-shaped lot characterized by an elongated extension providing access from a street to the principal part of the lot. Such a lot is typically the shape of a flag on a flag pole.
D.
LANDLOCKED LOTA lot which is surrounded on all sides by one or more lots and does not have a street connection and does not abut a street.
E.
THROUGH LOTAn interior lot having frontage on two streets. Also called a "double-frontage lot."
LOT AREA
The total area within the boundary lines of a single lot as computed and stipulated in Chapter
240, Zoning (as amended).
LOT DEPTH
The distance along a straight line drawn from the midpoint
of the front lot line to the midpoint of the rear lot line.
LOT LINES
The property lines bounding the lot.
A.
FRONT LOT LINE (STREET LINE)A lot line separating the lot from an existing or future street right-of-way (whichever contains a greater right-of-way width).
B.
REAR LOT LINEA lot line opposite and most distant from the front lot line. (A three-sided lot has no rear lot line.)
LOT WIDTH
The horizontal distance between side lot lines and/or side street lines measured at the minimum prescribed building setback line set forth in Chapter
240, Zoning.
MEETING, FORMAL
The advertised, regularly scheduled meeting of a Township
board or commission.
MEETING, WORKSHOP
The advertised, regularly scheduled workshop of a Township
board or commission.
MOBILE HOME PARK
A lot with the land under single ownership of record and
which has been planned and improved for the placement of two or more
mobile homes occupied as dwellings.
MONUMENT
A stone or concrete marker with a flat top at least four
inches in diameter, or square and at least 24 inches in length (preferred
30 inches to 36 inches). The monument shall be tapered so that the
dimensions at the bottom shall be at least two inches greater than
the top to minimize movement caused by frost.
NONINVASIVE TREES
All trees that are not defined as invasive trees.

OFFICE
A use that involves administrative, clerical, financial,
governmental or professional operations and operations of a similar
character. This use shall include neither retail nor industrial uses,
but may include business offices, medical or dental offices, clinics
or laboratories, photographic studios and/or television or radio broadcasting
studios.
OPEN SPACE
The unoccupied area of a lot. "Open space" does not include
the areas of principal and accessory structures, streets, driveway
or parking area, but may include areas occupied by walkways, patios
without roofs, playgrounds, stormwater management structures and other
areas occupied by outdoor recreation or play apparatus, lawns, gardens
and trees.

PADOT
The Pennsylvania Department of Transportation, also known
as PennDot, or its successor, and its subparts.
PARCEL
A tract of ground as described in the recorded deed description.
Parcels owned by the same owner(s) on either side of a public or private
road (or separated by construction of a public road) shall be considered
one lot.
PERSON
Includes a firm, company, corporation, partnership, trust,
organization or association, as well as an individual. When used in
a penalty provision, "person" shall include the members of such partnership,
the officers of such organization, association or corporation and
the trustees of such trust.
PLAN, CONSERVATION
A plan accompanying and forming part of the preliminary and
final plans detailing the applicant's measures to be taken for protection
of waterways, wetlands, stream channels, major trees, tree masses,
specimen trees and other important natural features and for erosion
and sediment control.
PLAN, CONSTRUCTION IMPROVEMENT
A plan prepared by a registered engineer or surveyor showing
the construction details of street, drains, sewers, bridges, culverts,
stormwater management structures and other improvements as required
by this chapter.
PLAN, FINAL
A complete and exact subdivision or development plan or plat, prepared for official recording as required by statute, which includes all information required under Article
VII of this chapter.
PLAN, MAJOR STREET
The element of the county's or Township's Comprehensive Plan,
which shall show the general location, alignment, dimensions and the
identification and classification of existing and proposed streets,
highways and other thoroughfares.
PLAN, OFFICIAL
The comprehensive development policy plan (Master Plan),
future land use plan, ultimate right-of-way plan and/or Official Map
or other such plans or portions thereof as may be adopted, pursuant
to statute, for the area of the Township in which the subdivision
is located.
PLAN, PRELIMINARY
A tentative subdivision or development plan, in lesser detail than a final plan, which includes all information required under Article
VI of this chapter.
PLAN, RECORD (TITLE)
The copy of the final plan which contains the original endorsements
of the County Planning Commission and the Township and which is intended
to be recorded with the County Recorder of Deeds.
PLAN, SKETCH
An informal plan, not necessarily to exact scale, indicating salient features of a tract and its surroundings and the general layout of a proposed subdivision or land development and which includes all information required under Article
V of this chapter.
PLANNED RESIDENTIAL DEVELOPMENT (PRD)
A PRD is an area of land controlled by a landowner to be
developed as a single entity for a number of dwelling units in a variety
of housing types and for those nonresidential uses deemed to be appropriate
for incorporation in the design of the planned residential development.
PLAT
The map or plan of a subdivision or land development, whether
preliminary or final.
RESERVE STRIP
A narrow parcel of ground (which is not to be used for building
purposes) separating an arterial street from another street.
RESIDENT PROPERTY OWNER
Any individual maintaining a voting address in the Township
or owning real estate in his own or joint names. A tenancy in common
or any other means of joint ownership shall be considered as an individual;
provided, however, that the signature of any single joint owner shall
be considered as binding the others.
RETENTION BASIN
A reservoir, formed from soil or other material, which is
designed to temporarily detain a certain amount of stormwater from
a drainage area in order to reduce the velocity and volume of peak
flows. Unlike detention basins, retention basins always contain water,
and thus may be considered man-made lakes or ponds.
REVIEW
An examination of the sketch plan, preliminary plan, and/or
final plan by the East Goshen Township Board of Supervisors and/or
other planning agencies and consultants so assigned to determine compliance
with this chapter and the administrative regulations, design standards
and improvement specifications enacted pursuant thereto.
RIGHT-OF-WAY
Land reserved for a street, crosswalk, utility or for other
public purposes.
ROADWAY
See definition of "cartway."
SANITARY SEWAGE DISPOSAL SYSTEM, CENTRALIZED/ON-LOT
A "centralized sewage disposal system" is a public utility
system or other system designed to collect, centrally treat and dispose
of sewage from users in compliance with regulations of the appropriate
state agency and of the Township. Any system which is not an approved
centralized sewage disposal system shall be deemed an "on-lot system."
SANITARY SEWAGE DISPOSAL SYSTEM, COMMUNITY
Any system, whether publicly or privately owned, for the
collection of sewage of a liquid nature from two or more lots, and
the treatment and/or disposal of the sewage on one or more of the
lots or at any other location for final disposal in whole or in part
into the soil. This includes land application by spray irrigation.

SANITARY SEWAGE DISPOSAL SYSTEM, ON-SITE
A system of piping, treatment tanks or other facilities serving
a single lot and collecting, treating and disposing of sewage into
a subsurface absorption area or spray irrigation system.

SANITARY SEWAGE DISPOSAL SYSTEM, PUBLIC
A sanitary sewage collection system in which sewage is carried
from individual lots by a system of pipes to a publicly-owned central
treatment and disposal plant.
SEDIMENT
The resulting residue from erosion.
SIGHT DISTANCE
The required length of roadway visible to the driver of a
passenger vehicle at any given point on the roadway when the view
is unobstructed by traffic.
SINGLE AND SEPARATE OWNERSHIP
The ownership of a lot by one or more persons, which ownership
is separate and distinct from that of any abutting or adjoining lot.
SITE AREA, GROSS
For purposes of this chapter, the total area of the parcel or tract (according to the recorded deed description) shall be as computed and stipulated in Chapter
240, Zoning (as amended).
SITE AREA, NET
For purposes of this chapter, "net site area" shall mean the gross site area less any areas that are required to be excluded according to Chapter
240, Zoning (as amended).
SOIL PERCOLATION TEST
A field test conducted to determine the suitability of the
soil for on-site sanitary sewage disposal facilities by measuring
the absorptive capacity of the soil at a given location and depth.
SPECIMEN TREE
A tree that is unique in either age, size, beauty, location,
species or condition as determined by a licensed arborist.

STATE
The Commonwealth of Pennsylvania and its agencies.
STEEP SLOPES
Unless otherwise stated, "steep slopes" shall mean areas with a change in elevation equal or greater than 15%. Such slopes shall be based upon and mapped using two-foot contours, unless another interval is preapproved by the Zoning Officer. Unless otherwise stated, for the purposes of Chapter
240, Zoning, the following shall not, by themselves, invoke the steep slope regulations of this chapter:
A.
If a maximum of only three adjacent two-foot
contours have slopes of 15% or greater; and/or
B.
If the steep slopes were clearly man-made and
not natural.
STORY and HALF-STORY
That portion of a building, included between the surface
of any floor and the ceiling next above it that is routinely accessible
by humans, and having an internal height of not less than 6 1/2
feet shall be considered a full story. Any such portion of a floor
of a building having an internal height of less than 6 1/2 feet
shall be considered a half-story. In addition, if more than 33% of
the perimeter walls around the ground level are below grade, then
such ground level shall not be considered to be a story.
STREET CLASSIFICATIONS - Street are classified as follows:
A.
EXPRESSWAYServes inter-regional and through trips with access limited to interchanges.
B.
ARTERIAL HIGHWAYServes moderate-to-long-distance travel with moderate to very high traffic volumes.
C.
COLLECTOR STREETServes short-to-moderate-distance travel at speeds usually averaging 40 to 45 miles per hour, and typically intended for 2,000 to 10,000 trips per day. These streets serve a mix of intra-regional and intermunicipal and intramunicipal trips.
D.
MINOR OR LOCAL STREETPrimarily serves local access for very short-distance travel with typical speeds of 15 to 25 miles per hour and with average daily traffic typically of less than 2,000 trips per day.
E.
CUL-DE-SACA minor street with access at one end and which is terminated by a vehicular turnaround.
F.
HALF (PARTIAL) STREETA street, generally parallel and adjacent to a property line, having a lesser right-of-way width than normally required for improvement and use of the street.
STREET, PRIVATE
A private thoroughfare which affords the principal means
of access to abutting property, including avenue, place, way, parkway,
drive, lane, boulevard, highway, road and any other thoroughfare except
an alley. (The private street is generally owned/maintained by a homeowners'
or condominium association and/or the abutting property owners.)
STREET, PUBLIC
A public thoroughfare which affords the principal means of
access to abutting property, including avenue, place, way, parkway,
drive, lane, boulevard, highway, road and any other thoroughfare except
an alley. A public street is dedicated to and maintained by the Township,
state or other governmental entity.
STRUCTURE
Any man-made object having ascertainable stationary location
on land or water, or on land and water, whether or not affixed to
the land. The term "structure" shall include buildings, signs, fences,
walls, towers, swimming pools, porches, garages and similar construction.
The term "structure" shall be interpreted as including the words "or
part thereof."
SUBDIVIDER
Any individual, copartnership or corporation (or agent authorized
thereby) which undertakes the subdivision of land, as defined by these
regulations, as the owner, lessee or equitable owner (or agent authorized
thereby) of the land being subdivided.
SUBDIVISION
The division or redivision of a lot, tract or parcel of land
by any means into two or more lots, tracts, parcels or other divisions
of land, including changes in existing lot lines for the purpose,
whether immediate or future, of lease, partition by the court for
distribution by heirs or devisees or transfer of ownership of building
or lot development; provided, however, that the subdivision by lease
of land for agricultural purposes into parcels of more than 10 acres,
not involving any new street, easement of access or any residential
dwelling, shall be exempted.
SURVEYOR
A licensed surveyor registered by the Commonwealth of Pennsylvania.
SWALE
A low-lying stretch of land which gathers, and/or carries,
surface water runoff across the ground.
SWIMMING POOL
A temporary or permanent structure containing a pool of water
with a depth of more than two feet, which is used or intended to be
used for swimming or bathing.
A.

TOWNSHIP
The Township of East Goshen, Chester County, Pennsylvania.
TOWNSHIP SECRETARY
The person appointed by the Board of Supervisors to be the
Secretary of the Township.
TRACT
The combined total lot area of the lot or lots that are held
in single ownership and are proposed for development. In the case
of a lot proposed to be subdivided into individual lots, the tract
shall be the original lot.
TRADE SCHOOL
A facility that is primarily intended for education of a
work-related skill or craft or a hobby, and which does not primarily
provide state-required education to persons under 16. This shall include
a dancing school, martial arts school or ceramics school.
TREE MASSES
A grouping of more than three trees of the same or different
variety to be treated as one unit.
TREE PROTECTION ZONE (TPZ)
An area that is radial to the trunk of a tree in which no
construction activity, movement of vehicles, placement of fill or
other land disturbance activities shall occur. The tree protection
zone shall be 25 feet from the trunk of the tree to be retained or
the distance from the trunk to the dripline, whichever is greater.
Where there is a group of trees or woodlands, the tree protection
zone shall be the aggregate of the protection zones for the individual
trees.

TREE SPECIMEN
Any tree (measured at a height of 4 1/2 feet) greater
than twelve-inch caliper within a tree mass and greater than six-inch
caliper outside the tree mass, and any unique or rare species of tree
greater than four-inch caliper existing in any location.
USE
Any purpose for which a building or other structure or tract
of land may be designed, arranged, intended, maintained or occupied,
or any activity or occupation carried on or intended to be carried
on in a building or other structure or tract of land.
WATER DISTRIBUTION, PUBLIC
A system for supplying and distributing water to individual
lots by a system serving more than one neighborhood and regulated
by the Pennsylvania Public Utility Commission.
WATER DISTRIBUTION SYSTEM, COMMUNITY
A system for supplying and distributing water from a common
source to dwellings and other buildings, but generally confined to
one neighborhood.
WETLAND MARGIN/FREEBOARD
The traditional area extending from the outer limits of the
wetland. The wetland margin of safety shall extend 100 feet from the
wetland boundary or to the limit of the hydric soils, whichever is
less.
WETLANDS
An area of land and/or water meeting one or more definitions
of "wetlands" under federal and/or Pennsylvania law and/or regulations,
whichever is more inclusive. [NOTE: As of 1994, the following was
the official United States Army Corps of Engineers' definition of
wetlands: "Those areas that are inundated or saturated by surface
or groundwater at a frequency and duration sufficient to support,
and that under normal circumstances do support, a prevalence of vegetation
typically adapted for life in saturated soil conditions. Wetlands
generally include swamps, marshes, bogs and similar areas." "Wetlands"
are technically defined on the basis of types of vegetation and soils
and the level of the water table below the surface. As of 1994, the
United States Army Corps of Engineers and the Pennsylvania Department
of Environmental Protection (PADEP) enforce the wetlands regulations.]
WILDFLOWER MEADOW
A naturally occurring or man-made vegetated landscape dominated
by wildflowers which are allowed to go to seed and which is mowed
annually, preferably in the fall.

WOODED LOT
Any lot having two or more viable, noninvasive trees, six
inches or greater in dbh, per every 1,500 square feet of gross lot
area, exclusive of street right-of-way.

YARD
An open space on the same lot with a building or group of
buildings measured from specified lot lines which restricts the locations
of buildings and structures and which is required to be unoccupied
and unobstructed from the ground upward, except as herein permitted.

YARD, FRONTA yard extending the full width of the lot measured parallel to the front lot line.
B.
YARD, REARA yard extending the full width of the lot measured parallel to the rear lot line.
C.
YARD, SIDEA yard extending from the front yard to the rear yard measured parallel to each side lot line.
D.
YARD, SIDE STREETA yard extending from the front yard to the rear yard measured parallel to the nearest side street lot line. A side street yard has the same requirements as a front yard.
