No person shall, except in necessary defense of person or property,
fire or discharge any gun or other firearm within the residential area of
the Township, designated as R-SS on the Township Zoning Map, except on existing
farms contained therein, unless a special permit has been obtained from the
Police Department of the Township of Mahoning.
The Police Department of the Township of Mahoning is hereby authorized
to grant special permits to residents within the above-described area who
find it necessary to kill wildlife within the area for the protection of their
crops, in accordance with Pennsylvania Game Laws.
Any person who violates or permits a violation of this chapter, shall,
upon conviction in a summary proceeding brought before a District Justice
under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary
offense and shall be punishable by a fine of not more than $1,000, plus costs
of prosecution. In default of payment thereof, the defendant may be sentenced
to imprisonment for a term not exceeding 90 days. Each day or portion thereof
that such violation continues or is permitted to continue shall constitute
a separate offense, and each section of this chapter that is violated shall
also constitute a separate offense.
No provision of this chapter is intended to in any way interfere with
safety regulations enacted by the Legislature of the commonwealth concerning
the carrying of firearms; nor is this chapter to be construed as permission
to hunt on private property without the approval of the property owner.
