The International Building Code, 2018 Edition, including Appendix Chapters E, F and J, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Rehoboth Beach, in the State of Delaware, and each and all regulations, provisions, penalties, conditions and terms of said Building Code are hereby referred to, adopted, and made part hereof, as if fully set out herein.

A. 
Site preparation activity, construction activity, and demolition activity disturbing 1,000 square feet of land area or more shall utilize appropriate perimeter protection, stabilized construction entrances, and stormwater inlet protection devices for construction site stormwater management consistent with the standards and specifications provided in the current version of the Delaware Erosion and Sediment Control (ESC) Handbook.
(1) 
A soil erosion and sediment plan showing the site's existing topography, indicating how it will be altered, identifying the control measures that will be installed, and describing how and when these controls will be implemented and maintained shall be submitted and approved prior to the issuance of a building permit.
(2) 
Every site subject to this section shall prominently display a sign of at least two feet by three feet providing notification to the public to contact the appropriate City officials in the event of erosion, runoff, or other failures of stormwater management measures. The sign shall be consistent with a sample sign provided by the City's Building and Licensing Department.
(3) 
No part of any vehicle used to deliver concrete, stones, soil, sod, or other construction or landscaping materials to a site subject to this section shall be washed, swept, or otherwise cleaned within streets or walkways in the City.
(4) 
In the event the measures utilized fail to contain sediment on the site, all street sweeping and sediment cleanup on the streets or walkways shall be in compliance with standards established in the Delaware Sediment and Erosion Control Handbook.
B. 
A violation of the provisions of this section shall be a civil offense pursuant to Chapter 126 of the Municipal Code of the City of Rehoboth Beach. Any person, firm or corporation who violates this article shall pay a civil assessment of $200. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
