A. 
No person shall keep, anchor, maintain or permit any boat owned or operated by him to be kept, anchored or maintained within 500 feet of the beach or strand immediately east of the limits of the City of Rehoboth Beach without the previous written consent of the Commissioners of Rehoboth Beach to do so.
B. 
Any person desiring to land, use or maintain a fishing boat upon the beach or strand of the city is hereby authorized to use the portion of the beach or strand lying between the southern end of the main boardwalk of the city and the corporate limits of the city to the south.
C. 
No person shall operate any boat within 300 feet of the beach or strand immediately east of the limits of the City of Rehoboth Beach.
D. 
No person shall operate any jet-ski or jet boat within 1,000 feet of the beach or strand immediately east of the limits of the City of Rehoboth Beach.
E. 
Any person violating any of the provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than $50 nor more than $200 or imprisoned for a period not more than 10 days, or both, and shall pay the costs of prosecution.
F. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
BOAT
Includes every description of watercraft used or capable of being used as a means of transportation.
JET-SKI or JET BOAT
Includes any boat being propelled by a jet pump with a fully enclosed impellor and not weighing over 350 pounds or having a length greater than 10 feet.
OPERATE
To use, navigate or employ.
A. 
No person shall operate or maintain any boat on Lake Gerar.
B. 
As used in this section, "boat" shall mean any boat, whether powered or unpowered. The term "boat" shall also include inflatable rafts, air-mattresses and air-filled tire tubes.

No person shall surf fish at any point along the beach or stand immediately east of Surf Avenue or the main Boardwalk during such times as city lifeguards are on duty, except from the jetty north of the Henlopen Hotel a distance of 250 feet north along the beach, which area shall be marked "No Swimming — Fishing Only." Any violation of this section is declared a civil offense pursuant to Chapter 126 of the Municipal Code of the City of Rehoboth Beach.
No person shall leave unburied on any beach or strand or other place within the city any fish, crabs or other products of the sea capable of decomposing or liable to give rise to noxious and offensive odors injurious to the health, conducive to the breeding or attracting of flies or other insects or so as to deprive others of the privilege of freely using or enjoying the beach or strand or other place.
No person 16 years of age or over may fish in Lake Gerar without having first obtained a license from the city.

A. 
Whenever in this chapter any act or failure to do a required act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision of this chapter shall be punished by a fine of not less than $50 nor more than $150, such fine to be in the discretion of the court, and such violator shall pay the costs of prosecution.
B. 
Whenever in this chapter there is no provision for a greater penalty for a second or subsequent conviction for a violation of this chapter, any person who has previously been convicted of the same violation shall be subject to a fine of not less than $75 nor more than $200 for each succeeding offense and shall pay the costs of prosecution.
