The Town of Ellington does hereby authorize the creation of an independent fund to accept voluntary contributions for the improvement of Town roads to be known as the "Ellington Road Improvement Fund."
Contributions for the fund may be received from developers, builders, property owners and others whose developments may necessitate improvements to (a) Town road(s) and such others who may desire to make contributions.
The fund shall not become a part of the general fund of the Town. The contributions shall be deposited in an account wherein the income of the fund shall accumulate until such a time as expenditures from the fund are authorized. The fund may be commingled in the discretion of the Finance Officer to maximize income and minimize management costs, provided that it shall always be accounted for as a separate fund.
A. 
The Board of Selectmen shall control the Road Improvement Fund and shall, when it deems it appropriate, recommend expenditures for the improvement of roads. In determining which roads are to be improved, the Board of Selectmen shall seek and receive the advice of the Planning and Zoning Commission.
B. 
The Board of Selectmen shall recommend expenditures from the fund only for the improvement of Town roads. Said fund may also be spent for design and construction costs, equipment, materials, engineering fees, land acquisitions, easements, legal fees and other expenses related to road improvements. Appropriations from said fund shall require the approval of the Board of Selectmen and the regular appropriation rules and procedures governing Town expenditures.
C. 
There shall be no requirement that the funds be spent for improvement to particular roads or that the improvements bear any particular relationship to the source of the funds.
