As used in this chapter, the following terms
shall have the meanings indicated:
PERSON
Includes individuals, companies, firms, societies, copartnerships,
corporations, associations, cooperatives and joint-stock companies.
The enforcement official designated to enforce
the provisions of this chapter shall be the Building Inspector of
the Township of Burlington.
All persons coming within the provisions of
this chapter shall comply with the following regulations:
A. Removal of construction debris. No person shall within
the limits of the Township of Burlington permit land to be covered
with or contain refuse or debris resulting from the construction activities
or the demolition of a building or other structure, which refuse or
debris has remained on a particular lot for more than 30 days after
the completion of said construction activities or said demolition
work on said particular lot.
B. Construction prohibited. No person shall unnecessarily
obstruct any street, avenue, road, highway, alley or public place
with any kind of vehicle or construction equipment, or both, or construction
or excavation material, but the provisions of this section shall not
prevent persons who are engaged in construction activities or demolition
work from occupying, with police approval, until notified by an official
of the Township of Burlington to cease such occupancy, 1/2 of the
street in front of the lot where they are so building, as long as
proper protective measures are taken, unless another person is engaged
in construction activities or demolition work on the opposite side
of the street, in which case neither shall occupy more than 1/4 of
the street; no person engaged in construction activities or demolition
work shall continue such occupancy of any street after notice from
any official or police officer of said Township to discontinue the
same.
C. Dust regulated. No person shall permit any land to
be barren or without sufficient cover to prevent dust and dirt from
being blown by the wind for a period greater than one week after the
clearing of said land. The cover may consist of seeding, grass or
other vegetation or any device or blanket-like object, subject to
the approval of the Township Engineer.
D. Noise regulated. No person shall permit any construction
to occur between the hours of 6:00 p.m. and 7:00 a.m. prevailing time
which requires outside lighting or which produces noise which would
reasonably be expected to disturb any person in the neighborhood.
E. Height regulation. No person shall permit dirt or
refuse or any material whatsoever to be piled to a height greater
than three feet which shall be within 40 feet of any public highway
or street; provided, however, upon the showing of necessity, the Building
Inspector of said municipality may grant an exception, not to exceed
30 days.
