The enforcement official is hereby authorized and directed to make inspections to determine the conditions of rooming, multifamily, rental residential units, and other residential units upon their resale, or rerental, located within the Township of Burlington, in order that he may perform his duties of safekeeping the health and safety of the occupants of rooming, multifamily, rental and residential units. For the purpose of making such inspections, the enforcement official is hereby authorized to enter, examine and survey during normal Township business hours, all rooming, multifamily, rental and residential units.
A. 
The owner or occupant of every rooming, multifamily, rental or residential unit or the person in charge thereof shall give the enforcement official, upon proper identification, free access to such units and his premises during normal Township business hours for the purpose of such inspection, examination and survey. Every occupant of rooming, multifamily, rental or residential units shall give the owner thereof or his agent or employee access to any part of such unit or its premises at all reasonable times for the purpose of making such repairs or alterations as are necessary to effect compliance with the provisions of this chapter or any lawful rule or regulation adopted or any lawful order issued pursuant to the provisions of this chapter. The owner of every rooming, multifamily, rental or residential unit or the person in charge thereof shall notify the Department of Licenses and Inspections within seven calendar days of any resale or rerental of any such unit in order that the Department of Licenses and Inspections may inspect said unit.
B. 
The owner or occupant of a rooming, multifamily, rental or residential unit may not rent, resell or occupy such unit without a certificate of continued occupancy.
C. 
The Department of Licenses and Inspections may issue a temporary certificate of continued occupancy for a period not to exceed 30 days to permit the owner to make such minor repairs which do not affect the health, safety and welfare of the occupant This permit will allow the owner or occupant of a rooming, multifamily, rental or residential unit to occupy such unit without a certificate of continued occupancy.
A. 
The enforcement official may, upon receipt of a petition to determine fitness of a private dwelling signed by at least five Township residents, apply to the Municipal Court Judge of the Township of Burlington for a search warrant.
B. 
The enforcement official may apply to the Municipal Court Judge of the Township of Burlington for a search warrant to gain access to any structure where he has probable cause that a violation of a Township ordinance is occurring or where such inspections are required as part of a routine inspection survey.

The rental property inspection fees for a single-family house, townhouse and a condominium unit shall be $100, with a reinspection fee of $50. The fee for an apartment inspection shall be $50, with a $50 reinspection fee.

Resale inspection fees for a single-family house, townhouse and a condominium unit shall be $100, with a reinspection fee of $50. The fee for a unit of affordable housing shall be $50, with a $20 reinspection fee.

C. 
Certificate of occupancy is valid for 60 days after date of issuance.
D. 
Chimney certificates and heater certificates are required for the resale and/or rental of all single-family units, townhouses, and condominium properties prior to issuance of certificates of occupancy.

E. 
The fee for an expedited inspection to be performed within five days of the request for the inspection shall be $200.

If reinspection is not completed within 60 days of the original inspection, a new inspection and payment of the inspection fee will be required.
