The Township Council is hereby authorized and
empowered to make and adopt by resolution such written rules and regulations
as it may deem necessary for the proper enforcement of the provisions
of this chapter; provided, however, that such rules and regulations
shall not be in conflict with the provisions of this chapter nor in
any way alter, amend or supersede any of the provisions thereof. The
Township Council shall, upon adoption by resolution of any rules and
regulations under the provisions of this section, file a certified
copy of all such rules and regulations which have been adopted in
the Office of the Township Clerk and in the office of the enforcement
official, wherein regulations are open for public inspection during
normal business hours.
No person shall occupy a dwelling, rooming house,
multifamily, rental or residential unit for the purpose of living
therein which does not conform with the provisions of the New Jersey
State Housing Code established hereby as a standard to be used in
determining whether a unit is safe, sanitary and fit for human habitation.
Further, it shall be the responsibility of the enforcement official
under the provisions of this chapter to enforce in concert with or
separate from agents for the State of New Jersey the provisions of
a code entitled "Regulations for Construction and Maintenance of Hotel
and Multi-Dwellings," prepared by the Department of Community Affairs
for the State of New Jersey, and in addition, such other regulations,
codes, ordinances or statutory provisions which bear on the habitability
or condition of any building, structure or dwelling unit or place
of occupancy within the Township of Burlington, County of Burlington
and State of New Jersey.
For the purpose of this chapter, the enforcement
official may determine that a dwelling, rooming, multifamily, rental
or residential unit is unfit for human habitation if he finds that
conditions exist in such unit which are dangerous or injurious to
the health, safety or welfare of the occupants of such unit, the occupants
of neighboring units or other residents of the Township of Burlington.
Such conditions may include, without limiting the generality of the
foregoing, defects therein increasing the hazards of fire, accident
or other calamities; lack of adequate ventilation, light or sanitary
facilities; dilapidation, disrepair, structural defect or uncleanliness.
Whenever a petition is filed with the Township
Clerk by a public authority, as defined in N.J.S.A. 40:48-2.4, or
by at least five residents of the municipality, charging that any
dwelling, rooming, multifamily, rental or residential unit is unfit
for human habitation, or whenever it appears to the enforcement official,
on his own motion, that any dwelling is unfit for human habitation,
he shall issue and cause to be served upon the owner of and parties
in interest in such dwelling, rooming, multifamily, rental or residential
unit a complaint stating the charges in that respect and containing
a notice as provided by this chapter.
