The office of Borough Administrator of the Borough of Eatontown is hereby created and shall be hereafter designated as "office of the Borough Administrator to the Mayor and Council of the Borough of Eatontown," and the appointee to said office shall hereafter be designated as "Borough Administrator."

The Borough Administrator shall be appointed by the Mayor with the advice and consent of the Council by majority vote and shall hold office at the pleasure of the governing body. The Administrator shall be removed only by a two-thirds vote of the Borough Council. The resolution of removal shall become effective three months after its adoption by the Borough Council. The governing body may provide that the resolution shall have immediate effect; provided, however, that the governing body shall cause to be paid to the Administrator forthwith any unpaid balance of his or her salary for the next three calendar months following adoption of the resolution. The Administrator shall be chosen by the governing body on the basis of his or her executive and administrative qualifications with specific reference to his or her actual training and/or experience in governmental affairs. At the time of his or her appointment, the Administrator need not be a resident of the Borough of Eatontown.

The salary of the Borough Administrator shall be as set forth in the Salary Ordinance for the Borough of Eatontown.[1]

A. 
The Borough Administrator to the Mayor and Council is designated as the Chief Administrative Officer of the Borough.
B. 
He shall be responsible to the governing body for the proper administration of his office, and to that end he shall study, recommend and implement the following after consultation with department heads and the consent of the governing body:
(1) 
Personnel organization and policy. He will advise Council on all hirings and separations of personnel.
(2) 
Administrative procedures.
(3) 
Receipt, dissemination and collection of, and responses to, communicants and information.
(4) 
Coordination, editing and prompt dissemination and release of public information.
(5) 
The financial procedures of the Borough and its departments.
(6) 
Procedures for the requisitioning, purchase, inspection, receipt, storage, inventory, distribution, internal transfer, disposal, standards and specifications and payment for supplies, materials and equipment.
C. 
He will be responsible for:
(1) 
Monitoring all purchases for compliance with Local Public Contract Guidelines (Chapter 198, Laws of 1971).
(2) 
The coordination of interdepartmental operations.
(3) 
Recommendations concerning the nature and location of public improvements.
(4) 
The negotiation of contracts for the Borough as authorized by the governing body.
(5) 
The protection of the Borough's or any of its inhabitants' interest in any statute or contracts to see that all terms and conditions are faithfully kept and performed, and to bring any violation to the attention of the governing body.
(6) 
Preparation and submission of the proposed Borough budget annually by requiring and receiving appropriation requests from heads of departments by November 15 and reviewing such requests with the committee of the governing body concerned, transmitting a report by January 1 and consulting with the governing body with respect thereto, and submitting by January 15 his final recommendation in the form required by law for municipal budgets and appending thereto a detailed analysis of the various items of expenditure and revenues and such explanatory comment or statement as he may deem desirable.
(7) 
Supervision of the financial procedures adopted by the governing body.
(8) 
The investment of Borough funds which shall be reported to Council for confirmation at the next public meeting.
(9) 
Reviewing procedures and security for any other funds controlled by another Borough body, except the Board of Health, and to recommend any corrective measures to the responsible member of the governing body.
(10) 
Keeping the Mayor and Council currently informed of all matters within his jurisdiction by such reports as he deems advisable, or as may be requested by them.
(11) 
Upon request, submit an annual report of his work for the benefit of the governing body and the public.
(12) 
Coordinating the Borough's efforts to obtain federal and state assistance. To that end he will investigate programs and make recommendation to Council concerning the Borough's participation. He shall develop and coordinate applications and supervise the execution of any state or federal program approved for Eatontown, including the preparation of all reports and control of all funds.
(13) 
Recommending to Council the type and quantity of office machines and equipment required for the efficient operation of the administrative and financial functions of the Borough. Specifically eliminated from this duty is machinery and equipment that would normally encompass computer, word processing and data communication activities, which duties are now the responsibility of the Information Technology Coordinator (see Article IX of this chapter).

(14) 
Maintaining the daily status of availability of all department heads and other designated key personnel and, in case of their absence, the reason, length of absence, if known, and the name of the person assuming their duties.[1]

(15) 
Developing all insurance programs for the protection of the Borough and its holdings and the supervising those approved by the Council.
D. 
He will attend all meetings of the governing body with the right to participate in discussions, but without the right to vote, except when excused therefrom by said governing body.
E. 
He will act as liaison with all boards, commissions, committees and other Borough bodies for the coordination of effort and information.

The following activities shall report directly to the Borough Administrator:
A. 
Director of Department of Finance.
B. 
Director of Department of Construction and Code Enforcement.
C. 
Director of Department of Public Works.
D. 
Director of Department of Recreation and Community Services.
E. 
Director of Department of Emergency Services.
F. 
Municipal Court Administrator.
G. 
Borough Clerk.
H. 
Chief of Police.
I. 
Division Managers in the Department of Administration.
Nothing herein contained shall derogate from or authorize the Borough Administrator to the Mayor and Council to exercise the powers and duties of any elected official of the Borough of Eatontown and the boards, bodies and commissions thereof established pursuant to law.
The ordinance creating the office of Administrative Assistant of the Borough of Eatontown dated February 1, 1965, as amended, is hereby rescinded and the within ordinance is substituted therefor.
