Any type of security alarm system which, when activated,
transmits a signal to an independent communication center not under
the control of the Township of Wayne or the Police Department, which
independent communication center, upon receipt of such signal, is
to take appropriate action, including the relaying of such information
to the Police Department communication center.
Any signal of a security alarm system activated by inadvertence,
carelessness or negligence, or an intentional or unintentional act
of a person other than an intruder, and including as well signals
caused by mechanical failure, malfunction or improper installation
of the security alarm system and related equipment.
Any type of alarm system, which, when activated, produces
a signal not connected to a central monitoring station or monitored
by some other agency such as an activating bell, siren or horn device
providing warning of intrusion or other peril. The term "local alarm"
shall not include a warning device on a motor vehicle, provided that
the system is not interconnected with an alarm device, a direct or
digital alarm. The term "local alarm" shall also not include any alarm
designed to signal solely within the building, or series of buildings,
(if owned by the same person) on which it is located and which is
not designed to emit signals visible or audible to persons outside
such building (or series of buildings).
Any alarm which, when activated, indicates an immediate medical
emergency at the announced location.
Any alarm which, when activated, indicates some immediate
peril at the announced location.
Any individual, firm, company, partnership, corporation,
association, group or society.
The Township of Wayne Police Department shall be responsible
for the enforcement of the provisions of this chapter.

It shall be unlawful for any person, owner, occupant or lessee
of any commercial, industrial building or the owner and/or lessee
of any single-family dwelling or multiple-family dwelling to:
A.
Cause, allow or permit the accidental or purposeful transmission
or audible sounding of a false alarm signal from any location within
the Township.
B.
Cause, allow or permit the report of any situation, condition, incident
or emergency which required a police, fire or medical response and
the report is subsequently determined to be unfounded.
A.
In
the case of a false alarm, the Chief of Police or his/her designee
shall cause an investigation to be made and a record kept on file
of the false alarm.
B.
Alarm
devices having an external audible alarm or any alarm installed outdoors
shall be designed and shall contain the necessary device and equipment
to limit the operation of a bell or sound producing instrument to
a maximum of 15 minutes after activation. If any local alarm having
an external alarm or an alarm installed outdoors has been activated
and continues to produce an audible sound, alarm or ringing for more
than 15 minutes, the person responsible for the alarm device shall,
upon conviction, be subject to a fine of not less than $100 or more
than $1,250.
C.
The
person responsible for the alarm device shall designate an individual
who shall have the authority to disable the alarm in the event the
person responsible is not present and the alarm device has failed
to automatically shut off after the 15 minutes time period. The person
responsible for the alarm device shall notify the Central Monitoring
Station of the individual and the contact information for that individual.

C.
Notwithstanding the terms and provisions of § 36-5A and B above, any alarm call that is canceled by a Central Monitoring Station prior to the Township of Wayne Police Department's arrival or emergency medical service's arrival at the location of the alarm shall not be considered a false alarm. Fire alarms can not be canceled.
