As used in this article, the following terms shall have the meanings indicated:
KENNEL
Any establishment wherein or whereon the business of boarding or selling dogs or breeding dogs for sale is carried on, except a pet shop.
PET DEALER
Any person engaged in the ordinary course of business in the sale of cats or dogs to the public for profit or any person who sells or offers for sale more than five cats or dogs in one year.

PET SHOP
Any place of business which is not part of a kennel, wherein animals, including, but not limited to, dogs, cats, birds, fish, reptiles, rabbits, hamsters or gerbils, are kept or displayed chiefly for the purpose of sale to individuals for personal appreciation and companionship rather than for business or research purposes.

POUND
An establishment for the confinement of dogs seized either under the provisions of Article I of this chapter or otherwise.
PUPPY MILL
Any commercial dog-breeding facility that does not possess a USDA Class A License and who owns or possesses more than 5 female dogs capable of reproduction in any 12 month period.

SHELTER
Any establishment where dogs are received, housed and distributed.

USDA LICENSE NUMBER
The license number issued to a breeder or broker by the United States Department of Agriculture pursuant to the federal "Animal Welfare Act," 7 U.S.C. s.2131 et seq., or any rules or regulations adopted pursuant thereto.

No licensing provision of this chapter shall be construed to apply to any establishment wherein or whereon animals are received or kept for diagnostic, medical, surgical or other treatments, owned by and operated under the immediate supervision of a graduate veterinarian licensed in the State of New Jersey.

A. 
No kennel, pet dealer, pet shop, shelter or pound shall be located, established or maintained within the Township unless the person who keeps or operates or proposes to establish such kennel, pet dealership, pet shop, shelter or pound shall obtain a license therefor. Application for the license shall be made to the Township Clerk on forms supplied by the Township Clerk. The Clerk, however, shall issue the license only after approval by the Health Department and ratified by the Township Council.

B. 
Any person holding a license issued under Subsection A of this section shall not be required to procure individual licenses for dogs owned by said licensee and kept at such establishment.
C. 
(1) 
No kennel, pet dealer or pet shop shall sell, offer for retail sale, barter, auction, or otherwise, dogs bred in puppy mills. Every kennel, pet dealer, or pet shop shall comply with the provisions of N.J.S.A. 56:8-95 through 56:8-95.1.
(2) 
No kennel, pet dealer or pet shop shall offer for sale, barter, auction or otherwise a dog or cat that is younger than 8 weeks old.
The application for a license under this article shall describe the premises where the establishment is located or is proposed to be located and the purpose or purposes for which it is to be maintained and shall be accompanied by the written approval of the Zoning Officer and Health Officer of the Township, showing compliance with the State laws and ordinances of the Township.

A. 
All licenses issued under this article for a kennel, pet dealer, pet shop, shelter or pound shall state the purpose for which the establishment is maintained and shall not be transferable to another owner or different premises. Such licenses shall expire on the last day of June of each year.
B. 
All such licenses shall be subject to revocation by the Council on recommendation of the State Department of Health or the Township Department of Health, for any failure to comply with the rules and regulations of the State Department of Health, or of the Township Department of Health governing the same, or the requirements of N.J.S.A. 56:8-95 through 56:8-95.1 of the "Pet Purchase Protection Act," L.2015, c. 7, § 3, after the licensee has been afforded a hearing by either the State or Township Department of Health.
A. 
The annual license fee for a kennel providing accommodations for 10 dogs or less or more than 10 shall be as provided in Chapter 75, Fees.

B. 
The annual license fee for a pet dealer or pet shop shall be as provided in Chapter 75, Fees.

C. 
No license fee shall be charged for a shelter or pound.
No dog kept in a kennel, pet shop, shelter or pound shall be permitted off such premises except on a leash or in a crate or other safe control.
The Health Officer shall forward to the State Department of Health a list of all kennels, pet shops, shelters or pounds licensed by the Township within 30 days after the licenses therefor are issued, which list shall include the name and address of the licensee and the kind of license issued.
