As used in this article, the following terms shall have the
meaning indicated:
CONTRACTOR OR BUILDER
Any person, firm or corporation who is engaged in a building
project or a project involving the installation of public utilities.

All builders and contractors shall conduct excavating operations
in such a manner as to provide maximum safety for employees and the
public. Suitable bridges, barricades, railings or other protection
around open trenches and excavations shall be provided as may be necessary
to assure such maximum safety. In addition thereto, open trenches
and excavations within public streets shall be posted with signs at
the site thereof and for at least 200 feet in either direction therefrom.
In the event that excavation within a street results in interfering
with the use of a private driveway, adequate measures shall be taken
in order that the use of a private driveway will not be interrupted
during the hours between 6:00 p.m. and 8:00 a.m. In the event that
conditions at the site of an open trench or excavation are such that
barricades and railings, in the opinion of the Director of Public
Works of the Township of Wayne, would not adequately provide for maximum
safety of the public, then the contractor shall provide one or more
guards at the site thereof during the hours specified by the Township
Engineer.
Any person who violates any provision of this article shall, upon conviction, be liable to the penalties stated in Chapter
1, Section
1-15.
