This Fair Share Plan Chapter addresses a fair share obligation
of 75 units, all of which are to be rehabilitated, as set forth in
the hereinabove referenced Exhibit A. (Exhibit A is available at the
Township Clerk's office.)
The housing rehabilitation program shall be administered in
accordance with the Wayne Township Rehabilitation Program Manual attached
hereto as Exhibit B. (Exhibit B is available at the Township Clerk's
office.)
Funding for the housing rehabilitation program shall be provided
by the township in accordance with the funding schedule set forth
in the hereinabove referenced Exhibit B. (Exhibit B is available at
the Township Clerk's office.)
At least $10,000 shall be allocated per housing unit, of which
at least $8,000 per unit shall be allocated to capital costs. The
Township may rehabilitate deficient units that meet the criteria herein
even if the actual capital costs are less than $8,000. At the end
of each two-year period, the total costs of rehabilitation shall average
$8,000 per unit.
Each housing unit to be rehabilitated shall be considered substandard
and shall be rehabilitated to standard condition in accordance with
requirements of the Uniform Construction Code of New Jersey.
Affordability controls shall be in effect for a period of at
least six years for owner-occupied units and 10 years for renter-occupied
units, pursuant to N.J.A.C. 5:92, Subchapter 12.
The affordability controls for each housing unit shall be set
forth in the applicable (owner-occupied or renter-occupied) deed restriction,
copies of which are attached hereto as Exhibit C; the deed restriction
for each rehabilitated housing unit shall be placed on file in the
County Hall of Records. (Exhibit C is available at the Township Clerk's
office.)
In the event that an owner-occupied unit is sold to an ineligible household by reason of income during the six-year period, all municipal funds expended for the rehabilitation of that unit shall be returned to the municipality and another substandard unit occupied by an income eligible household shall be rehabilitated. A lien shall be placed upon said unit for a six-year period as provided for in §§
214-6 and
214-7.
In no event may a renter-occupied unit be rented to an ineligible
household by reason of income during the ten-year affordability control
period. There shall be a ten-year lien placed upon said unit precluding
prepayment of the loan or grant during the ten-year period.
The Township shall administer the program with local staff,
as described in the aforementioned Exhibit B. (Exhibit B is available
at the Township Clerk's office.)
The Affordable Housing Board appointed pursuant to Chapter
213, Affordable Housing Regulations, of the Code of the Township of Wayne shall be responsible for marketing and outreach to locate eligible units and occupants, as well as the implementation of the rehabilitation program.
To the extent feasible, at least half of all rehabilitated units
shall be occupied by low-income households pursuant to N.J.A.C. 5:92-14.
The housing rehabilitation program shall be implemented within
the six-year-period of repose which was initiated on March 16, 1990,
and shall terminate on March 16, 1996.
