Any provisions of this chapter or any rules adopted herein may be enforced
by the Director of Code Enforcement of the Town of Cortlandt.
Any violation of this chapter or the rules and regulations promulgated
hereunder may be punished as follows:
A.Â
Civil penalties. The Director may, in his sole discretion,
choose to impose and collect a civil penalty not to exceed $1,000 for any
violation of this chapter. The Town Attorney is hereby authorized to commence
a civil action to collect the civil penalty herein in any court of competent
jurisdiction.
B.Â
Criminal offense. Any violation of this chapter or any
rule promulgated hereunder is hereby declared to be a violation punishable
by a fine not to exceed $250 or up to 15 days in jail. A criminal information
file alleging a violation of this chapter shall be in the form required by
the Criminal Procedure Law. Each day that a violation continues shall be deemed
to be a separate and distinct offense.
