This article is enacted to enhance the beauty and cleanliness of the streets, sidewalks, parks and other private and public property of the Village of Endicott by enforcing certain regulations and restrictions on the activities of canines.
No person owning, harboring, keeping, walking or having custody or control of a dog shall cause, permit or allow such dog to:
A. 
Soil, defecate on or commit any nuisance on any common thoroughfare, sidewalk, play area or park or on any public property, nor on any private property without the permission of the owner of said property. The foregoing restriction shall not apply to that portion of any street lying between the curblines, so long as all waste or feces deposited by such dog shall be immediately removed and disposed of by any sanitary method. In no event shall any waste or feces be deposited in sewers or drains, whether storm or sanitary.
B. 
Create a nuisance by defecating, urinating or digging on public property, or on private property without the consent or approval of the owner of such property. The owner shall immediately remove all feces left by such animal, depositing the same directly into an airtight container or bag, which shall then be deposited into a container used for the disposal of refuse. In no event shall any feces be deposited in sewers or drains, whether storm or sanitary.

A violation of any provision of this article is hereby deemed to be an offense punishable by a fine not to exceed $250 or imprisonment for a period not to exceed 15 days, or both. Each week's violation shall constitute a separate offense punishable by like penalty.
Any police officer or code enforcement official or dog control officer of the Village of Endicott or Town of Union is hereby authorized and empowered to enforce this article. In addition thereto, the Village Mayor shall have power to designate such other persons as he deems necessary in his discretion to enforce this article.
